MEMORANDUM IN SUPPORT OF LEGISLATION
submitted in accordance with Assembly Rule III, Sec 1(f)   BILL NUMBER: A774 SPONSOR: Lavine (MS)
  TITLE OF BILL: An act to amend the election law, in relation to voter pre-registration   PURPOSE: To allow 16- and 17-year-olds to pre-register to vote.   SUMMARY: OF PROVISIONS: Section 1 of the bill amends subdivision 4 of section 5-500 of the Election Law to add a new paragraph p that provides for the addition of a space on the voter registration form for pre-registering applicants. Section 2 of the bill amends the Election Law to add a new section 5-507. Section 5-507(1) allows a person who is at least 16-years-old, and is otherwise qualified to register to vote, to pre-register to vote, and makes the registration effective when the person reaches the age of eligibility. Section 5-507(2) requires local boards of education to adopt policies to promote student voter registration and pre-registration. Section 3 of this bill amends subdivision 5(g) of § 5-210 of the election law to update the registration form to reflect the ability of 16 and 17 year olds to pre-register to vote. Section 4 of the bill sets forth the effective date.   JUSTIFICATION: Currently, 14 states and the District of Columbia allow 16-year-olds to pre-register to vote, and an additional 4 states allow 17-year-Olds to pre-register to vote. This bill would add a section to the NeW York voter registration form allowing 16- and 17-year-olds to pre-register to vote. The boards of elections would store this informationland use it to register theappli- pants when they:reach the age of .eligibility folloWing verification of their qualifications'and address. The age of 16 is a sensible time to begin making registration materials available and collecting the information necessary to register new voters through the Department of Motor Vehicles (DMV), high schools and Other agencies involved in voter registration. Aaignificant number of people have their first interaction with the DMV:when'they are 16. Further, it is an age at which school is still compulaory in New York. Pre-registration allowe registration forms to be completed at a conven- ient time for the individual rather than making themreturn to the board of elections, the DMV, or another agency when they reach voting age. According to the U.S. Census Bureau, in 2014 only 37.4% of eligible New York voters between the ages of 18 and 24 were registered to vote (the most recent data available). This percentage is likely to increase when information is gathered to pre-register 16- and 17-year-olds in order to automatically register young voters when they reach an eligible voting age. A 2009 study by the Pew Charitable Trusts found that pre-registration laws did increase turnout when accompanied by outreach to young people. A person who is at least sixteen years of 5 age and who is otherwise qualified to register to vote may pre-register 6 to vote, and shall be automatically registered upon reaching the age of 7 eligibility as provided by this chapter. 8 2. Encouragement of student voter registration and pre-registration. 9 Local boards of education are required to adopt policies to promote 10 student voter registration and pre-registration. These policies may 11 include collaboration with county boards of elections to conduct voter 12 registration and pre-registration in high schools. Completion and 13 submission of voter registration or pre-registration forms shall not be 14 a course requirement or graded assignment for students. 15 § 3. Paragraph (g) of subdivision 5 of section 5-210 of the election 16 law, as amended by chapter 179 of the laws of 2005, is amended to read 17 as follows: 18 (g) Notice that the applicant must be a citizen of the United States, 19 [is or will be at least eighteen years old not later than December thir-20ty-first of the calendar year in which he or she registers] is at least 21 sixteen years old when he or she submits an application to register to 22 vote which will be effective for elections occurring on or after the 23 applicant turns eighteen years of age and a resident of the county or 24 city to which application is made. 25 § 4. This act shall take effect on the first of January next succeed- 26 ing the date on which it shall have become a law.
