        Introduced  by Sen. MARTINEZ -- read twice and ordered printed, and when
          printed to be committed to the Committee on Health
 
        AN ACT to amend the public health  law,  in  relation  to  the  sale  of
          flavored vapor products
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. Subdivision 2 of section 1399-mm-1  of  the  public  health
     2  law, as added by section 1 of part EE of chapter 56 of the laws of 2020,
     3  is amended to read as follows:
     4    2.  No  vapor  products  dealer,  or  any agent or employee of a vapor
     5  products dealer, shall sell or  offer  for  sale  at  retail,  or  store
     6  flavored  vapor  product  reasonably  intended for sale in the state any
     7  flavored vapor product intended or reasonably expected to be  used  with
     8  or for the consumption of nicotine.
     9    § 2. This act shall take effect immediately.
