TITLE OF BILL:
An act to amend the administrative code of the city of New York, in
relation to creating the blue light emergency phones pilot program and
to direct the commissioner of parks and recreation to study and report
upon the use of such program
 
PURPOSE OR GENERAL IDEA OF BILL:
This legislation is designed to ensure that New York City is properly
crafting a budget and tax levy that is within the constitutional
restraints placed on its tax limit.
 
SUMMARY OF PROVISIONS:
Section 1: Identifies tax exemptions and abatements that cannot be
considered as fluncollectibles" for purposes of calculating the amount
to be raised on real property taxes by the city of New York.
 
JUSTIFICATION:
The State Constitution imposes a tax limit of 2.5W on the city of New
York. In order to stay within this constitutional limit, New York City
has taken a unique position that certain tax exemptions should be
considered as uncollectible and therefore allowed to be considered with-
in the allowable tax levy. Uncollectible taxes are generally reserved
for properties where taxes cannot be collected one tax year in good
faith, but are expected to be collected in future years. A traditional
example of an uncollectible would be delinquent taxes where an owner
cannot be found. A good faith attempt must be made to find this owner
and there is an expectation that the taxes will be collected the follow-
ing year. This scenario is easily distinguished from an exemption or
abatement where the taxes are not being collected by operation of law.
For example on a ten year abatement, there is no expectation that in
year two the taxes will be collectible the following year. This inaccu-
rate characterization has been identified by reports and this legis-
lation seeks tc ensure New York City is properly operating within its
constitutional tax limit.

AN ACT to amend the administrative code of the city of New York, in
relation to creating the blue light emergency phones pilot program and
to direct the commissioner of parks and recreation to study and report
upon the use of such program
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. The administrative code of the city of New York is amended
2 by adding a new section 18-159 to read as follows:
3 § 18-159 Blue light emergency phones pilot program. In one park, oper-
4 ated by or under the jurisdiction of the department, in each of the five
5 boroughs, the department shall implement a blue light emergency phones
6 pilot program for the purpose of public safety. Under such program, the
7 department shall install blue lighted emergency phones that, when used,
8 shall automatically dial 9-1-1 and ring directly to the police depart-
9 ment.
10 § 2. The commissioner of parks and recreation shall cause a study to
11 be performed to analyze how the implementation of blue light emergency
12 phones pilot program in parks impacts public safety compared to parks
13 without such a program.
14 § 3. On or before three hundred sixty-five days after all five
15 locations identified for the blue light emergency phones pilot program
16 have become operational, the commissioner of parks and recreation shall
17 complete the study conducted pursuant to section two of this act and
18 shall thereafter deliver a copy of the findings of the study and any
19 legislative recommendations he or she deems to be necessary to the
20 governor, the temporary president of the senate, the speaker of the
21 assembly and the mayor of the city of New York.
22 § 4. This act shall take effect on the ninetieth day after it shall
23 have become a law.
