NEW YORK STATE ASSEMBLY
MEMORANDUM IN SUPPORT OF LEGISLATION
submitted in accordance with Assembly Rule III, Sec 1(f)

BILL NUMBER: A516

SPONSOR: Rosenthal L
TITLE OF BILL: An act providing for rules and regulations for state aid reimbursement for the purchase of opioid antagonists by municipalities   PURPOSE: To reimburse state municipalities for the purchase of opioid antag- onists.   SUMMARY OF SPECIFIC PROVISIONS: Section one requires establishment of rules and regulations for state aid reimbursement to municipalities purchasing opioid antagonists. Section two sets forth the effective date.   JUSTIFICATION: The New York State Department of Health recently revised guidance to recognize that local health departments' response to the opioid epidemic is an appropriate core public health service. Newly eligible services include facilitating distribution of naloxone and making referrals to agencies and organizations that distribute naloxone. However, purchase of naloxone is deemed an ineligible service and cost because it is clas- sified as a safety device and not a medication. This legislation requires the Department of Health to reclassify purchase of naloxone as an eligible expense for Article Six State Aid for General Public Health Work reimbursement. The work of local health departments is essential to ensuring that New York State is blanketed with overdose prevention resources, and this legislation aims to empower them to save lives.   LEGISLATIVE HISTORY: 2021-22: A.1516 - Referred to Health 2019-20: A.1134 - Referred to Health 2017-18: A.10992 - Referred to Health   FISCAL IMPLICATIONS: Undetermined.   EFFECTIVE DATE: This act shall take effect immediately.
