TITLE OF BILL:
An act to amend the state finance law, in relation to decarbonization
plans for state-owned fleet vehicles; and to repeal certain provisions
of the executive law relating thereto
 
PURPOSE OR GENERAL IDEA OF BILL::
This bill provides technical amendments to Chapter 789 of the Laws of
2022.
 
SUMMARY OF PROVISIONS::
This chapter amendment would:
*narrow the scope of the original legislation to exclude public authori-
ties;
*shift the planning requirements from the Executive Law to the State
Finance Law; and,
*maintain the requirement for interim goals and timeframes from the
original legislation, which included:
*directing each State agency to prepare a State Fleet Decarbonization
Plan for light-duty non-emergency vehicles by December 31, 2023, and
medium- and heavy-duty vehicles by December 31, 2025;
*requiring all State agency light-duty non-emergency vehicles to be zero
emission by December 31, 2035; and,
*requiring all State agency medium- and heavy-duty vehicles to be zero
emission by December 31, 2040, unless a zero emission vehicle is not
feasible.
 
JUSTIFICATION::
This bill directs each State agency to prepare and implement a state
fleet decarbonization plan for the purchase or lease of light, medium
and heavy-duty zero emission vehicles, requires the adoption of interim
goals and establishes a timeframe for compliance. The Scoping Plan,
established by the Climate Action Council, recommends transitioning
State-owned fleet vehicles to zero emission vehicles to reduce green-
house gas emissions. The planning process in Chapter 789 of the Laws of
2022 as well as these technical amendments will help facilitate the
achievement of that goal.

EFFECTIVE DATE::
This act shall take effect on the same date and in the same manner as a
chapter of the laws of 2022 amending the executive law relating to the
purchase or lease of zero emission vehicles for state-owned vehicle
fleets, as proposed in legislative bill numbers 5.2838-C and A.2412-B,
takes effect.

AN ACT to amend the state finance law, in relation to decarbonization
plans for state-owned fleet vehicles; and to repeal certain provisions
of the executive law relating thereto
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Subdivision 10 of section 201-a of the executive law, as
2 added by a chapter of the laws of 2022 amending the executive law relat-
3 ing to the purchase or lease of zero emission vehicles for state-owned
4 vehicle fleets, as proposed in legislative bills numbers S. 2838-C and
5 A. 2412-B, is REPEALED.
6 § 2. The state finance law is amended by adding a new section 163-d to
7 read as follows:
8 § 163-d. Decarbonization plans for state-owned fleet vehicles. 1.
9 Each state agency shall prepare a state fleet decarbonization plan for
10 purchase or lease of state agency vehicles. The state fleet decarboni-
11 zation plans for light-duty non-emergency vehicles shall be prepared on
12 or before December thirty-first, two thousand twenty-three, and the
13 state fleet decarbonization plans for medium- and heavy-duty vehicles
14 shall be prepared on or before December thirty-first, two thousand twen-
15 ty-five. Such plans shall include interim targets for achieving fleet
16 decarbonization goals.
17 2. All state agency light-duty non-emergency vehicles shall be zero
18 emission vehicles by no later than December thirty-first, two thousand
19 thirty-five, and all state agency medium- and heavy-duty vehicles shall
20 be zero emission vehicles by no later than December thirty-first, two
21 thousand forty, unless a zero emission vehicle is not feasible for a
22 particular application.
23 § 3. This act shall take effect on the same date and in the same
24 manner as a chapter of the laws of 2022 amending the executive law
25 relating to the purchase or lease of zero emission vehicles for state-
26 owned vehicle fleets, as proposed in legislative bills numbers S. 2838-C
27 and A. 2412-B, takes effect.
