  TITLE OF BILL: An act to amend the vehicle and traffic law, in relation to prohibiting tinted windows in sport utility vehicles   PURPOSE OR GENERAL IDEA OF BILL: This bill amends the vehicle and traffic law by holding Sport Utility vehicles to the same 70% tinting standard as other passenger vehicles.   SUMMARY OF SPECIFIC PROVISIONS: Section one of the bill amends subparagraphs 3 and 4 of paragraph (b) of subdivision 12-a of § 375 of the vehicle and traffic'law to include sport utility vehicles as motor vehicles which are prohibited to be operated on a public highway, road, or street if any rear side window has a light transmittance of less than seventy percent. This section also removes a provision that states that rear windows may be tinted darker if the car is equipped with side mirrors.   JUSTIFICATION: Under current Vehicle and Traffic law, sport utility vehicles are held to different tinting laws and this bill would hold SUVs to the same standards as other passenger vehicles.   PRIOR LEGISLATIVEHISTORY: 2021-22: A.2188 -Transportation 2019-20: A.3682-Transportation 2017-18: A.3726-Transportation 2015-16: A.303 -Transportation 2013-14: A.361 -Transportation 2011-12: A.792 -Transportation 2009-10: A.1042 -Transportation 2007-08: A.4423 -Transportation 2005-06: A.8260 -Transportation   FISCAL IMPLICATIONS: None.   EFFECTIVE DATE: This act shall take effect on the one hundred eightieth day after it shall have become a law.

        AN ACT to amend the vehicle and traffic law, in relation to  prohibiting
          tinted windows in sport utility vehicles

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Subparagraphs 3 and 4 of paragraph (b) of subdivision  12-a
     2  of section 375 of the vehicle and traffic law, as amended by chapter 155
     3  of the laws of 1991, are amended to read as follows:
     4    (3) if it is classified as a station wagon, sedan, sport utility vehi-
     5  cle,  hardtop,  coupe, hatchback or convertible and any rear side window
     6  has a light transmittance of less than seventy percent; or
     7    (4) the rear window of which is composed of,  covered  by  or  treated
     8  with  any  material which has a light transmittance of less than seventy
     9  percent. [A rear window may have a  light  transmittance  of  less  than
    10  seventy  percent  if  the  vehicle is equipped with side mirrors on both
    11  sides of the vehicle so adjusted that the driver thereof  shall  have  a
    12  clear  and  full  view  of the road and condition of traffic behind such
    13  vehicle.]
    14    § 2. This act shall take effect on the one hundred eightieth day after
    15  it shall have become a law.
