  TITLE OF BILL: An act to amend chapter 20 of the laws of 1985 creating the Sanborn Volunteer and Exempt Firemen's Benevolent Association, Inc., and provid- ing for its powers and duties, in relation to its purpose and the use of foreign fire insurance premiums   PURPOSE: To authorize the Sanborn Volunteer and Exempt Firemen's Benevolent Asso- ciation to provide the relief, aid and assistance of members and their families who are injured.   SUMMARY OF PROVISIONS: Section 1: Section 3 and 7 of chapter 20 of the laws of 1985 creating the Sanborn Volunteer and Exempt Firemen's Benevolent Association, Inc., and providing for its powers and duties, are amended. Section 3 is amended to change the purpose of the association to provide the relief, aid and assistance of such members and their families who are injured, disabled or indigent. To promote and safeguard the welfare of the volun- teer members of the corporation and their families; to provide for the health and safety of the volunteer members of the corporation and to enhance the morale of the volunteer members of the corporation by providing social and recreational activities for the volunteer members of the corporation. Section 7 is amended to fix a technical error. Section 2 is the effective date.   JUSTIFICATION: Volunteer firefighters perform dangerous duties each and every day in our communities. They offer reliable protection to our health, well-be- ing and property. They receive no compensation for their efforts except our heartfelt thanks and a small "pension like" benefit after years of service. These changes were requested by the Sanborn Volunteer and Exempt Firemen's Benevolent Association and are identical to language found in the formation of the Cold Spring Harbor Fire Benevolent Associ- ation in 2018, and the revision of the existing association in North Tarrytown in 2019.   LEGISLATIVE HISTORY: A.8608B of 2021-22   FISCAL IMPLICATIONS: None to the State.   EFFECTIVE DATE: This act shall take effect immediately and shall apply to taxes due on premiums received on and after January 1, 2024,

        AN ACT to amend chapter 20 of the laws  of  1985  creating  the  Sanborn
          Volunteer  and  Exempt  Firemen's  Benevolent  Association,  Inc., and
          providing for its powers and duties, in relation to  its  purpose  and
          the use of foreign fire insurance premiums
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Sections 3 and 7 of chapter 20 of the laws of 1985 creating
     2  the Sanborn Volunteer and Exempt Firemen's Benevolent Association, Inc.,
     3  and providing for its powers and duties, are amended to read as follows:
     4    § 3. Purposes. The purposes of such corporation shall be  the  mainte-
     5  nance  of suitable headquarters for, and the promotion of friendly asso-
     6  ciation for the betterment of the members of such corporation and  their
     7  relations with the community, for the promotion of fraternal intercourse
     8  among  the  members  of such corporation, to study and disseminate among
     9  the members of such corporation the most efficient  manner  of  fighting
    10  fires, the relief, aid and assistance of such members and their families
    11  who  are injured, disabled or indigent, for the promotion and safeguard-
    12  ing of the welfare of the volunteer  members  of  such  corporation  and
    13  their  families,  for  the  provision  for  the health and safety of the
    14  volunteer members of such corporation, and for the  enhancement  of  the
    15  morale  of  the  volunteer  members  of  such  corporation  through  the
    16  provision of  social  and  recreational  activities  for  the  volunteer
    17  members  of  the  corporation,  and  the promotion of the volunteer fire
    18  service within the territory protected by such fire  department  of  the
    19  Sanborn Volunteer and Exempt Firemen's Benevolent Association, Inc., and
    20  to  acquire  real and personal property such as may be necessary for the
    21  purposes herein set forth and the promotion of the welfare of the volun-
    22  teer fire service within the territory now served or which may hereafter
    23  be served by the Sanborn Fire Company.
 
         EXPLANATION--Matter in italics (underscored) is new; matter in brackets

     1    § 7. Precept for payment of foreign fire insurance premium taxes. Such
     2  corporation shall collect and there  shall  be  paid  to  it  all  taxes
     3  imposed  by  section nine thousand one hundred four of the insurance law
     4  for fire department use and benefit upon premiums for insurance  against
     5  loss  or damage by fire covering property within the territory protected
     6  by Sanborn Fire Company within the town of Lewiston located  in  Niagara
     7  county,  New  York.  The  officers of said corporation designated by its
     8  by-laws to collect and receive the aforesaid  tax  shall  have  all  the
     9  powers and be subject to all the provisions of the insurance law, relat-
    10  ing  to  treasurers  of fire departments. Such corporation shall also be
    11  entitled to receive a share of  the  tax  distributed  pursuant  to  the
    12  provisions  of  section  nine thousand one hundred five of the insurance
    13  law, based upon the business written in the territory  with  respect  to
    14  which  it  is entitled to collect and receive the tax under section nine
    15  thousand one hundred four of the insurance law. Such taxes shall only be
    16  used [for the care and relief of  disabled  or  indigent  volunteer  and
    17  exempt  volunteer  firemen  and  their  families]  by the corporation in
    18  furtherance of its purposes as set forth in section three of this act.
    19    § 2. This act shall take effect immediately and shall apply  to  taxes
    20  due on premiums received on and after January 1, 2024.
