NEW YORK STATE ASSEMBLY
MEMORANDUM IN SUPPORT OF LEGISLATION
submitted in accordance with Assembly Rule III, Sec 1(f)

BILL NUMBER: A3048

SPONSOR: Pretlow
TITLE OF BILL: An act to amend the education law, in relation to school districts being notified when a teacher is dismissed from a school district due to sexu- al improprieties   PURPOSE OF BILL: Relates to the dismissal of teachers for sexual improprieties.   SUMMARY OF SPECIFIC PROVISIONS: This bill would amend Section 1. The education law is amended by adding a new section 115 to read as follows: Notification to school districts of a teacher's dismissal due to sexual impropriety. When a teacher has been dismissed from a school district due to a sexual impropriety and such sexual impropriety has been proven in a court of law, such informa- tion shall be placed on the teacher's permanent record and the former school district shall reveal the reasons for such dismissal to all school districts throughout the state which inquire into such teacher's dismissal.   JUSTIFICATION: The one place that parents should feel that their children are safe is in our schools. Recent stories in the news have made it clear that this is not always the case. Tragically, danger in schools don't only come from drugs and violence, but from teachers themselves. Current, high profile news stories have shown us that not all teachers have the student's best interest at heart; they have turned out to be sexual predators. From a political and moral standpoint, it is important for elected offi- cials to protect our youth. This bill, if it became a law, would help in that effort. This is an important piece of legislation that must take effect immediately. It should be clear to everyone that passing this bill is extremely important in order to enable the safety and well-being of all students.   LEGISLATIVE HISTORY: 2021-2022 A1684 referred to Education 2019-2020 A1843 referred to Education 2017-2018 A2584 referred to education A2472 2009/2010 referred to education 01/12/15 referred to education 01/06/16 referred to education   FISCAL IMPLICATIONS: None to state.   EFFECTIVE DATE: This act shall take effect On the first of July next succeeding the date on which it shall have become a law.
