TITLE OF BILL:
An act to amend the education law, in relation to apportionment of
public moneys to school districts employing eight or more teachers in
high need districts
 
PURPOSE OR GENERAL IDEA OF BILL:
This bill would amend the apportionment of public moneys to school
districts which employ eight or more teachers in high need districts.
 
SUMMARY OF PROVISIONS:
Section 1 - Amends subparagraph 4 of paragraph q of subdivision 3 of
section 3602 of the education law, as amended by section 13 of part B of
chapter 57 of the laws of 2008.
Section 2 - Provides the effective date
 
JUSTIFICATION:
This bill will address the consequence of a district which satisfies the
high needs aid definition but is identified as An average needs based on
previous classification data. According to the Association of School
Officials, for the school year 2017-2018 high needs districts had the
highest spending increase with the lowest levy increase.

AN ACT to amend the education law, in relation to apportionment of
public moneys to school districts employing eight or more teachers in
high need districts
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Subparagraph 4 of paragraph g of subdivision 3 of section
2 3602 of the education law, as amended by section 13 of part B of chapter
3 57 of the laws of 2008, is amended to read as follows:
4 (4) a value computed by subtracting from fifty-one hundredths the
5 product obtained by multiplying the combined wealth ratio by twenty-two
6 hundredths, provided, however, that for the purpose of computing the
7 state sharing ratio for total foundation aid, the tier four value shall
8 be computed by subtracting from fifty-one hundredths the product
9 obtained by multiplying the combined wealth ratio by one hundred seven-
10 ty-three thousandths and such values shall be computed using the
11 combined wealth ratio for total foundation aid in place of the combined
12 wealth ratio, and, for high need school districts, as determined pursu-
13 ant to (i) clause (c) of subparagraph two of paragraph c of subdivision
14 six of this section for the school aid computer listing produced by the
15 commissioner in support of the enacted budget for the two thousand
16 seven--two thousand eight school year and entitled "SA0708", or (ii)
17 designated as high need pursuant to the regulations of the commissioner
18 in the study included in the school aid computer listing produced by the
19 commissioner in support of the enacted budget for the two thousand thir-
20 teen--two thousand fourteen state fiscal year and entitled "SA131-4"
21 known as the 2008 need resource capacity category code, such values
22 shall be multiplied by one hundred five percent.
23 § 2. This act shall take effect immediately.
