A06038 Memo:

NEW YORK STATE ASSEMBLY
MEMORANDUM IN SUPPORT OF LEGISLATION
submitted in accordance with Assembly Rule III, Sec 1(f)

BILL NUMBER: A6038

SPONSOR: Dinowitz
TITLE OF BILL: An act to amend the executive law and the not-for-pro- fit corporation law, in relation to a public listing of certain not-for- profit corporations   PURPOSE: This bill requires a public listing of the certificates of incorporation that have been approved by the Adjutant General for purposes of solicit- ing funds or other benefits for the armed forces of the United States or of any foreign country.   SUMMARY OF PROVISIONS: Section one and two direct the Adjutant General, together with the Department of State, to make public the names of the entities that have been approved for the purpose of soliciting funds or obtaining other benefits for the armed forces of the United States or of any foreign country. Section three provides that this act shall take effect 120 days after becoming law.   JUSTIFICATION: Current law requires the Adjutant General to sign off on any not-for- profit incorporating for the purposes of soliciting funds or other bene- fits for the armed forces of the United States, a foreign country, or the auxiliaries of this state or any other. However, there is no public listing of the not-for-profits that have been approved by the Adjutant General. Making this information publically available will help New Yorkers, who wish to make donations to not-for-profits incorporated for the purpose of supporting our armed forces, ensure that they are donating to legiti- mate organizations.   LEGISLATIVE HISTORY: New Bill.   FISCAL IMPLICATIONS: None to the state   EFFECTIVE DATE: This act shall take effect 120 days after becoming law.
