NEW YORK STATE ASSEMBLY
MEMORANDUM IN SUPPORT OF LEGISLATION
submitted in accordance with Assembly Rule III, Sec 1(f)

BILL NUMBER: A6279

SPONSOR: Brown K
TITLE OF BILL: An act to amend the executive law, in relation to requiring the depart- ment of criminal justice services to monitor desk appearance tickets and report on the rate which principals appear in court on such tickets   PURPOSE: Requires the department of criminal justice services to monitor desk appearance tickets and report on the rate which principals appear in court on such tickets.   SUMMARY OF SPECIFIC PROVISIONS: Section 1: The executive law is amended by adding a new section 837-x. Section 2: Identifies effective date.   JUSTIFICATION: The Bail Reform Law of 2020 dramatically changed the criminal justice system to create offenses that are not bail eligible and, instead, a desk appearance ticket is issued by the arresting officer. During the Joint Legislative Budget hearings, the Commissioner of department of criminal justice services indicated that no data is collected unless the criminal defendant is fingerprinted. Therefore, the state has no way of knowing if an.individual who is issued a Desk Appearance Ticket appears in court to answer the charges brought against them and the frequency of same to determine if the reform measures are working properly. This bill would require the department of criminal justice services to monitor desk appearance tickets and report on the rate which principals appear in court on such tickets.   LEGISLATIVE HISTORY: New Bill   FISCAL IMPLICATIONS: None   EFFECTIVE DATE: This act shall take effect immediately.
