  TITLE OF BILL: An act directing the commissioner of transportation to waive an annual security deposit fee   PURPOSE OR GENERAL IDEA OF BILL: Allowing for the use of approximately 4,000 square feet of state land located adjacent to 325 Bedford Road for the purpose of providing exclu- sive parking for volunteer firefighter members of the Bedford Hills Fire District.   SUMMARY OF PROVISIONS: Section 1: Directs the commissioner of transportation to waive the annu- al security deposit fee specified in Use and Occupancy Permit No. 82771 issued to the Bedford Hills Fire District, Town of Bedford, Westchester County allowing for the use of approximately 4,000 square feet of state land located adjacent to 325 Bedford Road for the purpose of providing exclusive parking for volunteer firefighter members of the Bedford Hills Fire 8 District.   DIFFERENCE BETWEEN ORIGINAL AND AMENDED VERSION (IF APPLICABLE): This is a new bill.   JUSTIFICATION: The Bedford Hills Fire Department serves and protects their community on a volunteer basis. Adjacent to the fire station is a vacant property owned by the New York State Department of Transportation. The Depart- ment has issued a permit which allows parking by the members of the Bedford Hills Fire Department but the annual cost to the fire department to lease the land is in excess of $17,000. This vacant property currently generates no revenue for the state and there is no competing use that would lead to any revenue in the future. This bill provides access to the property without an unjust enrichment by New York State.   PRIOR LEGISLATIVE HISTORY: This is a new bill.   FISCAL IMPLICATIONS FOR STATE AND LOCAL GOVERNMENTS: None to the state.   EFFECTIVE DATE: This bill takes effect immediately.

        AN ACT directing the commissioner of transportation to waive  an  annual
          security deposit fee
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. Notwithstanding any provision of law to the  contrary,  the
     2  commissioner  of  transportation shall waive the annual security deposit
     3  fee specified in Use and  Occupancy  Permit  No.  82771  issued  to  the
     4  Bedford  Hills Fire District, Town of Bedford, Westchester County allow-
     5  ing for the use of approximately 4,000 square feet of state land located
     6  adjacent to 325 Bedford Road for  the  purpose  of  providing  exclusive
     7  parking  for  volunteer  firefighter  members  of the Bedford Hills Fire
     8  District. The provisions of this act shall  not  affect  or  impair  any
     9  other provision of said Use and Occupancy Permit.
    10    § 2. This act shall take effect immediately.
