  TITLE OF BILL: An act to amend the cannabis law, in relation to requiring all edible cannabis products be packaged in child resistant packaging   PURPOSE: To package edible cannabis products in child resistant packaging to prevent children from consuming edible cannabis.   SUMMARY OF PROVISIONS: Section 1. Section 125 of the cannabis law is amended by adding a new subdivision 13 to read as follows: 13. (a) No registered organization, licensee, or permittee or other entity under the jurisdiction of the board shall sell, or agree to sell or deliver in this state any edible cannabis product that is not in child resistant packaging. (b) For the purposes of this subdivision, "edible cannabis product" shall mean a "cannabis-infused product" as defined in subdivision ten of section three of this chapter that is intended for consumption.   EXISTING LAW: None   JUSTIFICATION: Packaging edible cannabis products in child resistant packaging will put an end to children accidentally consuming edible cannabis products. Many children are getting sick due to this consumption. NBC news reports state that calls to poison control centers have risen for kids ages 5 and under consuming edibles containing THC. Numbers in 2017 rose from 207 kids to 3,054 in 2021. The American Academy of Pediatrics lists this issue as one of their top legislative priorities in 2023 to keep chil- dren safe and healthy.   LEGISLATIVE HISTORY: New bill   FISCAL IMPLICATIONS: None   LOCAL FISCAL IMPLICATIONS: None.   EFFECTIVE DATE: This act shall take effect on the one hundred eigh- teith day after it shall become a law.

        AN ACT to amend the cannabis law, in relation to  requiring  all  edible
          cannabis products be packaged in child resistant packaging
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Section 125 of the cannabis law is amended by adding a  new
     2  subdivision 13 to read as follows:
     3    13.  (a)  No  registered organization, licensee, or permittee or other
     4  entity under the jurisdiction of the board shall sell, or agree to  sell
     5  or  deliver  in  this  state  any edible cannabis product that is not in
     6  child resistant packaging.
     7    (b) For the purposes of this subdivision,  "edible  cannabis  product"
     8  shall mean a "cannabis-infused product" as defined in subdivision ten of
     9  section three of this chapter that is intended for consumption.
    10    § 2. This act shall take effect on the one hundred eightieth day after
    11  it  shall have become a law. Effective immediately, the addition, amend-
    12  ment and/or repeal of any rule or regulation necessary for the implemen-
    13  tation of this act on its effective date are authorized to be  made  and
    14  completed on or before such effective date.
