NEW YORK STATE ASSEMBLY
MEMORANDUM IN SUPPORT OF LEGISLATION
submitted in accordance with Assembly Rule III, Sec 1(f)

BILL NUMBER: A7277

SPONSOR: Simone
TITLE OF BILL: An act to amend the Hudson river park act, in relation to prohibiting a heliport within the boundaries of the Hudson river park   SUMMARY OF SPECIFIC PROVISIONS: Section 1. Legislative findings. The planning, development, maintenance, and operation of the Hudson river park is a matter of state concern and will enhance and protect the natural, cultural, and historic aspects of the Hudson river; enhance and afford quality public access to the river; allow for an array of cultural and recreational programs; and provide a host of other public benefits. The changes to the 1998 law by this act are intended to further enhance and protect the river and increase public access and enjoyment of the Hudson River Park. § 2. Amends paragraph (g) of section 3 of the Hudson river park act to remove a nontourism/non-recreation heliport for commercial and emergency transportation use from the definition of "Park/commercial use." § 3. Amends paragraph (j) of section 3 of the Hudson river park act, to remove the exception of a heliport as a "Prohibited use." § 4. Amends paragraph (m) of section 3 of the Hudson river park act, to remove a heliport as an allowable "Water dependent use." § 5. Amends paragraph (i) of subdivision 9 of section 7 of the Hudson river park act to remove a heliport building and associated structures and extend an interim use until July 2028. § 6. Allows for severability. § 7. Effective date.   JUSTIFICATION: A heliport is not compatible with a public park. It creates noise and air pollution and interferes with the enjoyment of the park. Addi- tionally, helicopters are a threat to our environment and undermine the goals of the Climate Leadership and Community Protection Act. One heli- copter produces 43 times more carbon dioxide per hour than an average car.   LEGISLATIVE HISTORY: New bill   FISCAL IMPLICATIONS: None.   EFFECTIVE DATE: This act shall take effect on the ninetieth day after it shall have become a law. allowing for regulations and other actions necessary to implement this act on that date.
