TITLE OF BILL:
An act to amend the vehicle and traffic law and the administrative code
of the city of New York, in relation to increasing fines for repeated
parking violations
 
PURPOSE:
The purpose of this bill is to allow for increased fines related to
parking violations when there are a significant number of repeat
violations within a two-year period.
 
SUMMARY OF SPECIFIC PROVISIONS:
Section 1. Amends subdivision 2 of section 237 of the vehicle and traf-
fic law to allow for increases in the maximum penalties after ten
violations within a twenty four month period.
Section 2. Amends subdivision b of section 19-203 of the administrative
code of the city of New York to allow for• increases in the maximum
penalties after ten violations within a twenty four month period.
Section 3 sets forth the effective date.
 
JUSTIFICATION:
Current parking fines are ineffective at deterring repeat violations.
In New York City alone, between October of 2021 and September of 2023,
65% of parking violations went to vehicles with two or more of the same
violation withing that twenty-four month period. Additionally in that
period, 54,356 vehicles received over twenty summonses for the same
parking violation.
This legislation would increase fines for the drivers who regularly
violate parking laws by increasing the maximum fine by 100% after a
driver accrues ten violations within a two-year period. The maximum fine
would then increase by another 100% for each subsequent violation in
that period to a maximum of 500%.
When a parking ticket is viewed as the cost of doing business, drivers
are more likely to regularly violate parking rules, leading to dangerous
situations for drivers, cyclists and pedestrians.
 
PRIOR LEGISLATIVE HISTORY:
This is a new bill.
 
FISCAL IMPLICATIONS:
None.
 
EFFECTIVE DATE:
This act shall take effect on the thirtieth day after it shall have
become a law.

AN ACT to amend the vehicle and traffic law and the administrative code
of the city of New York, in relation to increasing fines for repeated
parking violations
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Subdivision 2 of section 237 of the vehicle and traffic
2 law, as amended by chapter 458 of the laws of 2010, is amended to read
3 as follows:
4 2. To provide for penalties other than imprisonment for (a) parking
5 violations in accordance with a schedule of monetary fines and penal-
6 ties, provided however, that monetary penalties shall not exceed fifty
7 dollars for each parking violation other than (i) in a city with a popu-
8 lation of one million or more, violations committed in spaces where
9 stopping or standing is prohibited for which monetary penalties shall
10 not exceed one hundred dollars and, (ii) handicapped parking violations
11 for which monetary penalties shall not exceed one hundred fifty dollars,
12 provided that the maximum penalties set forth in this paragraph may be
13 increased by one hundred percent for more than ten violations within a
14 twenty-four month period and an additional one hundred percent of the
15 maximum penalty for each subsequent violation within twenty-four months
16 up to five hundred percent of the maximum fine set forth in this para-
17 graph; and (b) abandoned vehicle violations, except in a city with a
18 population of one million or more, provided however, that monetary
19 penalties shall not be less than two hundred fifty dollars nor more than
20 one thousand dollars for each abandoned vehicle violation; and (c) a
21 city with a population of one million or more may impose a monetary
22 penalty of up to two hundred fifty dollars for a first offense and up to
23 five hundred dollars for subsequent offenses within a six month period
24 for tractor-trailer combinations, tractors, truck trailers and semi-
25 trailers parked overnight on streets in residential neighborhoods;

1 § 2. Subdivision b of section 19-203 of the administrative code of the
2 city of New York, as amended by section 2 of part B of chapter 93 of the
3 laws of 2002, is amended to read as follows:
4 b. To provide for penalties other than imprisonment for parking
5 violations, provided however, that monetary penalties shall not exceed
6 fifty dollars for each parking violation, provided that monetary penal-
7 ties shall not exceed one hundred dollars for each parking violation
8 committed in a space where stopping or standing is prohibited and
9 provided, further, that monetary penalties shall not exceed one hundred
10 fifty dollars for each handicapped parking violation, and further
11 provided that the maximum penalties set forth in this subdivision may be
12 increased by one hundred percent for more than ten violations within a
13 twenty-four month period and an additional one hundred percent of the
14 maximum penalty for each subsequent violation within twenty-four months
15 up to five hundred percent of the maximum fine set forth in this subdi-
16 vision;
17 § 3. This act shall take effect on the thirtieth day after it shall
18 have become a law.
