  TITLE OF BILL: An act to amend chapter 54 of the laws of 1938 authorizing Exempt Fire- men's Benevolent Association of Hastings on the Hudson, Inc., to collect, receive and use taxes required to be paid pursuant to the insurance law upon premiums on policies of fire insurance on property in the village of Hastings on the Hudson, New York, or other territory served by the fire department thereof, in relation to the use of taxes collected   PURPOSE OR GENERAL IDEA OF BILL: This bill will amend chapter 54 of the laws of 1938 to update the purposes and duties of the association, as well as the use of funds received from foreign fire insurance companies be collected and distrib- uted in accordance with sections 9104 and 9105 of the insurance law.   SUMMARY OF PROVISIONS: Section 1 amends the chapter to add duties to the association, including to maintain a suitable headquarters, provide aid to members who are indigent, disabled, or injured in the line of duty, promote and safe- guard the welfare of members and their families, provide for their health and safety, enhance morale by providing social and recreational activities for members and promote volunteer fire service in the village of Hastings on the Hudson. Section 2 is the effective date.   JUSTIFICATION: This bill will amend the provisions for the distribution of foreign fire insurance funds to make the use of said funds consistent with sections 9104 and 9105 of the insurance law.   PRIOR LEGISLATIVE HISTORY: None   FISCAL IMPLICATIONS FOR STATE AND LOCAL GOVERNMENTS: None   EFFECTIVE DATE: This act shall take effect immediately and shall apply to taxes due on premiums received on and after January 1, 2025.

        AN ACT to amend chapter 54 of the laws of 1938 authorizing Exempt  Fire-
          men's  Benevolent  Association  of  Hastings  on  the Hudson, Inc., to
          collect, receive and use taxes required to be  paid  pursuant  to  the
          insurance  law upon premiums on policies of fire insurance on property
          in the village of Hastings on the Hudson, New York, or other territory
          served by the fire department thereof, in relation to the use of taxes
          collected
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1.  Section  1  of chapter 54 of the laws of 1938 authorizing
     2  Exempt Firemen's Benevolent Association of Hastings on the Hudson, Inc.,
     3  to collect, receive and use taxes required to be paid  pursuant  to  the
     4  insurance law upon premiums on policies of fire insurance on property in
     5  the  village  of  Hastings  on  the Hudson, New York, or other territory
     6  served by the fire department thereof, is amended to read as follows:
     7    Section 1. Exempt [Firemen's] Firefighters' Benevolent Association  of
     8  [Hastings on the Hudson] Hastings-on-Hudson, Inc., a domestic membership
     9  corporation  of the village of [Hastings on the Hudson] Hastings-on-Hud-
    10  son in the town of  Greenburgh  in  the  county  of  Westchester,  shall
    11  collect  and  there  shall be paid to it all tax imposed by section [one
    12  hundred and thirty-three] nine thousand one hundred four of  the  insur-
    13  ance  law  upon premiums on policies of fire insurance covering property
    14  situated within the limits of the village of [Hastings  on  the  Hudson]
    15  Hastings-on-Hudson  in  the  town  of Greenburgh, Westchester county, as
    16  such village now is or may hereafter  be  established  or  extended,  or
    17  within any duly organized territory in which the fire department of said
    18  village  is  obligated  to  render fire protection, and such corporation
    19  shall use any such taxes so collected or paid to it, [for  the  care  of
    20  indigent  members  of such corporation and their families] to maintain a
    21  suitable headquarters for the volunteer members of the  corporation,  to
    22  provide  relief,  aid  and  assistance to the volunteer members  of such
    23  corporation who are indigent or disabled or injured in  the  performance

     1  of   their duties, and their families; and to promote, and safeguard the
     2  welfare of the volunteer members of the corporation and their  families,
     3  to  provide  for  the  health and safety of the volunteer members of the
     4  corporation,  and  to enhance the morale of the volunteer members of the
     5  corporation by providing social  and  recreational  activities  for  the
     6  volunteer  members of the corporation and the promotion of the volunteer
     7  fire service within the village of Hastings-on-Hudson  and  also  within
     8  the  territory  provided  with fire protection by the Hastings-on-Hudson
     9  Volunteer Fire Department;  provided,  however,  that  such  corporation
    10  shall  remit  such  percentage of all such taxes so collected or paid to
    11  it, to the treasurer of the [Firemen's] Firefighters Association of  the
    12  State  of New York, as may be required by the insurance law. The officer
    13  of such corporation designated by its by-laws to collect and receive the
    14  aforesaid tax shall have all the  powers  and  be  subject  to  all  the
    15  provisions  of  section [one hundred and thirty-three] nine thousand one
    16  hundred four of the insurance law relating to treasurers of fire depart-
    17  ments. Such corporation shall also be entitled to receive a share of the
    18  tax imposed by section [one hundred and forty-nine-a] nine thousand  one
    19  hundred  five  of  the insurance law, based upon the business written in
    20  the territory with respect to  which  it  is  entitled  to  collect  and
    21  receive  the tax under section [one hundred and thirty-three] nine thou-
    22  sand one hundred four of the insurance law, and to  use  same  [for  the
    23  care  of  indigent  members  of  such corporation and their families] to
    24  maintain a suitable headquarters for the volunteer members of the corpo-
    25  ration, to provide relief, aid and assistance to the  volunteer  members
    26  of  such  corporation  who  are  indigent  or disabled or injured in the
    27  performance  of  their duties, and their families; and to  promote,  and
    28  safeguard  the  welfare  of the volunteer members of the corporation and
    29  their families, to provide for the health and safety  of  the  volunteer
    30  members  of  the corporation, and to enhance the morale of the volunteer
