TITLE OF BILL: An act to amend the public service law, in relation to
directing the public service commission to conduct a study of the
Reforming the Energy Vision initiative
 
PURPOSE:
This bill would direct a study of the Reforming the Energy Vision initi-
ative by the public service commission.
 
SUMMARY OF PROVISIONS:
Section one amends the public service law by adding a new section 66-o.
Section two establishes the effective date.
 
JUSTIFICATION:
This bill seeks data to determine the benefits and cost of effectiveness
of REV.

AN ACT to amend the public service law, in relation to directing the
public service commission to conduct a study of the Reforming the
Energy Vision initiative
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. The public service law is amended by adding a new section
2 66-o to read as follows:
3 § 66-o. Reforming the Energy Vision study. 1. The commission shall
4 annually conduct a study to analyze the economic and environmental bene-
5 fits and the economic costs and environmental burden, of the Reforming
6 the Energy Vision initiative (REV), the progress of achieving REV
7 related goals, and a description of all current regulatory, tariff, and
8 market designs and incentive structures that are intended to achieve REV
9 related goals. Such study and analysis shall include, but not be limited
10 to:
11 (a) an analysis of the initiatives costs and benefits for the purposes
12 of this study, the commission shall consider the impacts of reforming
13 the energy vision on electric rates charged to consumers through addi-
14 tional fees, increased rates or any other charges required to support
15 the initiative.
16 (b) a quantification of the approximate avoided level of emissions
17 including, but not limited to, information concerning: nitrogen dioxide,
18 sulfur dioxide and carbon dioxide, as well as other air pollutants
19 deemed necessary and appropriate for study by the commission, provided
20 the commission shall use its best efforts to determine environmental
21 leakage which occurs when there is an increase in air emissions outside

1 of New York as a result of energy load leaving New York due to the
2 increased cost of REV or REV related infrastructure costs for a
3 location with higher emissions per capita. The study shall also quantify
4 the economic costs and benefits of REV to participants and non-partici-
5 pants, by rate classes and shall further disaggregate the results by
6 utility.
7 (c) data on the impact on consumers resulting from the cost and
8 expense of replacing existing energy infrastructure including energy
9 transmission and distribution infrastructure; and market platform tech-
10 nology.
11 2. The commission shall publish a report based on its findings. The
12 report must be published within three hundred sixty-five days of the
13 effective date of this section, and every year thereafter. A copy of the
14 report must be furnished to the temporary president of the senate, the
15 speaker of the assembly, the chair of the senate energy and telecommuni-
16 cations committee and the chair of the assembly energy committee.
17 § 2. This act shall take effect immediately.
