MEMORANDUM IN SUPPORT OF LEGISLATION

  TITLE OF BILL: An act to amend the public health law, in relation to automated external defibrillators   PURPOSE OR GENERAL IDEA OF BILL: This bill would clarify that any health care practitioner who has the necessary experience, prescribing authority, and scope of practice, may enter into a collaborative agreement with a person or entity seeking to possess and/or operate an automated external defibrillator.   SUMMARY OF SPECIFIC PROVISIONS: Section 1 of the bill amends public health law section 3000-b to define health care practitioner and clarify that any professional who meets this definition may enter into a collaborative agreement with a public access defibrillation provider, in order to facilitate availability. Section 2 is the effective date.   JUSTIFICATION: Current law allows individuals or entities to purchase and operate auto- mated external defibrillators (AEDs) if the individual or entity has a collaborative agreement with a physician or a hospital. There are many other qualified health care practitioners in New York, such as physician assistants and nurse practitioners, who may be able to facilitate AED access and thereby increase AED availability statewide. This legislation continues the same high safety standards including all training and reporting requirements, while expanding the availability of automated external defibrillators to such practitioners.   PRIOR LEGISLATIVE HISTORY: New bill   FISCAL IMPLICATIONS: None   EFFECTIVE DATE: One hundred eighty days after becoming law, provided that effective immediately the commissioners of health and education shall make regu- lations and take other actions necessary to implement the act on such date.

        AN ACT to amend the public health law, in relation to automated external
          defibrillators
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:

     1    Section  1.  Paragraph  (b)  of subdivision 1 of section 3000-b of the
     2  public health law, as added by chapter 552  of  the  laws  of  1998,  is
     3  amended to read as follows:
     4    (b)  "Emergency health care provider" means (i) a physician with know-
     5  ledge and experience in the delivery of  emergency  cardiac  care;  [or]
     6  (ii)  a  physician  assistant  or  nurse practitioner with knowledge and
     7  experience in the delivery of emergency cardiac care, and who is  acting
     8  within  his or her scope of practice; or (iii) a hospital licensed under
     9  article twenty-eight of this chapter  that  provides  emergency  cardiac
    10  care.
    11    § 2. This act shall take effect on the one hundred eightieth day after
    12  it  shall  have  become a law; provided that, effective immediately, the
    13  addition, amendment, and/or repeal of any rules and  regulations  neces-
    14  sary  to  implement the provisions of this act on its effective date are
    15  authorized and directed to be completed  on  or  before  such  effective
    16  date.
