  TITLE OF BILL: An act to amend part T of chapter 57 of the laws of 2017, constituting the clean water infrastructure act of 2017, in relation to the effec- tiveness thereof   PURPOSE: This bill would amend the Clean Water Infrastructure Act of 2017 to provide for emergency financial assistance to be available immediately.   SUMMARY OF PROVISIONS: Section 1 amends Section 14 of Part T of Chapter 57 of the Laws of 2017 (the Clean Water Infrastructure Act of 2017) to provide for emergency financial assistance to be available immediately. Section 2 provides for an immediate effective date.   JUSTIFICATION: The Clean Water Infrastructure Act of 2017 that was recently passed as a part of the 2017-18 Enacted Budget provides for water infrastructure emergency financial assistance. Upon the declaration of an emergency in a municipality, the Department of Environmental Conservation or the Department of Health must determine if there is an imminent hazard to the public health or welfare or to the environment. If a hazard or the threat of a hazard is found, temporary emergency assistance must be provided to the municipality. Such assistance must be provided within two business days after the amount is determined. In its original form, this assistance would not be available until 120 days after the effective date, or August 18, 2017. However, due to the nature of emergency situations currently faced by municipalities across the state and in anticipation of such emergency situations in the near future, this bill would remove the 120 day waiting period, providing for immediate emergency financial relief.   LEGISLATIVE HISTORY: New bill   FISCAL IMPLICATIONS: None   EFFECTIVE DATE: Immediately

        AN  ACT  to amend part T of chapter 57 of the laws of 2017, constituting
          the clean water infrastructure act of 2017, in relation to the  effec-
          tiveness thereof

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Section 14 of part T of chapter 57 of  the  laws  of  2017,
     2  constituting  the  clean water infrastructure act of 2017, is amended to
     3  read as follows:
     4    § 14. This act shall take effect immediately; provided, however,  that
     5  [emergency  financial  assistance  will  not  be available under section
     6  1285-t of the public authorities law  established  pursuant  to  section
     7  eight  of  this  act  until one hundred twenty days after this act shall
     8  take effect; and provided further that] the provisions of  section  nine
     9  of  this act shall take effect on the one hundred eightieth day after it
    10  shall become a law.
    11    § 2. This act shall take effect immediately.
