MEMORANDUM IN SUPPORT OF LEGISLATION
submitted in accordance with Assembly Rule III, Sec 1(f)

  TITLE OF BILL: An act to amend the tax law and the state finance law, in relation to establishing the New York state rural mobile communications fund   PURPOSE OR GENERAL IDEA OF BILL: To create The New York State Rural Communications Fund for the purpose of assisting rural New York with funding needed to increase cellular service in low to no coverage areas.   SUMMARY OF PROVISIONS: Section 1 amends section 186-f of New York State Tax Law by requiring forty-one and seven-tenths of the revenues collected and received under this section into the New York state rural mobile communications fund. Section 2 amends New York Sate Finance Law by adding a new section establishing the New York state rural mobile communications fund in joint custody of the commissioner of taxation and finance and the comp- troller. Such fund shall consist of all revenues received pursuant to Paragraph (a) of subdivision 5 of section 186-f of the tax law. Requires funds deposited to be used for the purpose of providing rural areas with grants for the purpose of increasing cellular service in low- to no-cov- erage areas. Priority shall be given to applicants in rural areas who can identify public safety concerns resulting from lack of cellular service. Section 3 provides the effective date.   JUSTIFICATION: Across rural New York, many residents are left with little to no cell phone coverage due to lack of funding and accessibility. This bill would ensure that these New Yorkers are provided with the necessary financial help in order to deliver cellular coverage to those in rural areas and help to avoid certain public safety concerns due to lack of coverage.   PRIOR LEGISLATIVE HISTORY: New bill.   FISCAL IMPLICATIONS FOR STATE AND LOCAL GOVERNMENTS: To be determined.   EFFECTIVE DATE: This act shall take effect on the first of January

        AN ACT to amend the tax law and the state finance law,  in  relation  to
          establishing the New York state rural mobile communications fund
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Paragraph (a) of subdivision 5 of section 186-f of the  tax
     2  law,  as added by section 3 of part B of chapter 56 of the laws of 2009,
     3  is amended to read as follows:
     4    (a) forty-one and seven-tenths of the revenues collected and  received
     5  under  this section into the [state general] New York state rural mobile
     6  communications fund established pursuant to  section  ninety-nine-rr  of
     7  the state finance law; and
     8    § 2. The state finance law is amended by adding a new section 99-rr to
     9  read as follows:
    10    §  99-rr.  New York state rural mobile communications fund. 1.  Estab-
    11  lishment of the fund. There is hereby established in the  joint  custody
    12  of  the state comptroller and the commissioner of taxation and finance a
    13  special fund to be known as the New York  state  rural  mobile  communi-
    14  cations  fund.  Moneys  in  this  account shall be kept separate and not
    15  commingled with any other moneys in the custody of the comptroller.
    16    2. Source of funds. The sum equal to the amount  identified  in  para-
    17  graph (a) of subdivision five of section one hundred eighty-six-f of the
    18  tax law shall be credited to the fund.
    19    3.  Use of funds. Such moneys shall be used for the purpose of provid-
    20  ing rural areas, as defined in subdivision eight of section two  hundred
    21  sixty  of  the agriculture and markets law, in the state with grants for
    22  the purpose of increasing cellular service in low- to no-coverage areas.
    23  Priority shall be given to applicants in rural areas  who  can  identify
    24  public safety concerns resulting from lack of cellular service.

     1    §  3. This act shall take effect on the first of January next succeed-
     2  ing the date upon which it shall have become a law. Effective immediate-
     3  ly, the addition, amendment and/or repeal  of  any  rule  or  regulation
     4  necessary  for  the implementation of this act on its effective date are
     5  authorized to be made and completed on or before such effective date.
