        Introduced  by  Sen.  CROCI  -- read twice and ordered printed, and when
          printed to be committed  to  the  Committee  on  Local  Government  --

        AN  ACT  authorizing  the alienation of certain parklands in the town of
          Islip, county of Suffolk
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1.  Notwithstanding  the failure of the town of Islip, in the
     2  county of Suffolk, to seek and receive state  legislative  authorization
     3  to alienate the parklands described in section four of this act prior to
     4  such  parkland  being  alienated,  such  alienation is hereby validated,
     5  legalized, ratified and confirmed.
     6    § 2. Subject to the provisions of this act, the town of Islip,  acting
     7  by  and  through  its town board, is hereby authorized to discontinue as
     8  parklands and alienate the lands more particularly described in  section
     9  four of this act.
    10    §  3.  The authorization, granted pursuant to section two of this act,
    11  shall be subject to a requirement that the town  of  Islip  dedicate  an
    12  amount  equal  to  or  greater  than the fair market value of the parcel
    13  described in section four of this act for capital improvements of exist-
    14  ing park and recreational facilities and/or  the  acquisition  of  addi-
    15  tional park and recreational facilities.
    16    §  4.  The  land  to  be  discontinued  as  parkland and alienated and
    17  conveyed, consisting  of  14.59  acres,  is  bounded  and  described  as
    18  follows:
    19    All that certain plot, piece or parcel of land, with the buildings and
    20  improvements  thereon erected, situate, lying and being in central Islip

     2  and being more particularly described as follows:

     4  formed by the southerly side of Smith  St.  and  the  westerly  side  of

    20    §  5. If the land that is the subject of this act has received funding
    21  pursuant to the federal land and water conservation fund, the discontin-
    22  uance of parklands authorized by the provisions of this  act  shall  not
    23  occur  until the municipality has complied with the federal requirements
    24  pertaining to the conversion  of  parklands,  including  satisfying  the
    25  secretary  of  the  interior  that  the  discontinuance will include all
    26  conditions which the secretary of the interior deems necessary to assure
    27  the substitution of other lands shall be equivalent in fair market value
    28  and recreational usefulness to the lands being discontinued.
    29    § 6. This act shall take effect immediately.
