AN ACT to amend the public authorities law, in relation to establishing
the affordable residential green building program
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. The public authorities law is amended by adding a new
2 section 1872-a to read as follows:
3 § 1872-a. Affordable residential green building program. Notwith-
4 standing any law, rule or regulation to the contrary, the authority
5 shall establish and administer a program pursuant to standards and
6 criteria established by the authority which would provide incentives to
7 owners for the construction of new residential buildings which are
8 affordable. For purposes of this section, "affordable" means where the
9 homebuyer has a household income which does not exceed the income limits
10 defined by the state of New York mortgage agency low interest rate mort-
11 gage program in the non-target, one-and two-person household category
12 for the county where such property is located. Such incentives shall be
13 available based upon the use of design and building techniques estab-
14 lished or promulgated by the authority which promote smart growth and
15 smart planning, reduce greenhouse gas emissions, achieve energy effi-
16 ciency and reduce energy consumption, facilitate the incorporation of
17 environmentally responsible products, promote the efficient use of all
18 heating fuels and natural resources, reduce waste and create a healthy
19 indoor living environment while maintaining affordability for household
20 incomes as provided in this section. The authority shall promulgate
21 rules and regulations to establish affordable green residential building

1 standards and criteria, in addition to administrative regulations for
2 implementation of such program. The authority shall prepare an annual
3 report on such program which shall be posted on the authority's website.
4 § 2. This act shall take effect immediately.
