  TITLE OF BILL: An act to amend the education law, in relation to enacting the student journalist free speech act   PURPOSE OR GENERAL IDEA OF BILL: To provide greater free speech for student expressions in school spon- sored student publications. This bill would allow for student independ- ence and individual initiative; student ownership of their publication which would foster a greater sense of civic engagement and increase the protections of student journalistic expression.   SUMMARY OF PROVISIONS: An Act to amend the education law by adding a new Article 18 which would be entitled "Student Journalist Free Speech Act". Section 861 would define school officials; school sponsored media; student journalist and student media advisor. Section 862 would provide for the rights and responsibilities of the students, media advisors and school officials. Section 863 provides for exemptions that would not be protected under this bill. Section 864 addresses liability and misconduct   JUSTIFICATION: Currently, school districts can and do regulate the content of school sponsored student publications. This bill seeks to affirm a student's right to free expression by providing greater independence for the students while maintaining a school districts right to regulate the school sponsored student publication.   PRIOR LEGISLATIVE HISTORY: New Bill   FISCAL IMPLICATIONS FOR STATE AND LOCAL GOVERNMENTS: none to the state   EFFECTIVE DATE: Immediately
