Assemblyman Santabarbara Announces BIG WIN for People with Disabilities

New supported decision-making law protects the rights of people with disabilities

Assemblyman Angelo Santabarbara announced that legislation to allow supported decision-making as an alternative to guardianship for individuals with developmental, intellectual or cognitive disabilities was signed into law (Ch. 481 of 2022).

“New York State is home to thousands of individuals living with disabilities, all of whom face unique challenges,” said Santabarbara. “While many people with developmental and intellectual disabilities depend on guardians for certain decisions, the opportunity to exercise self-representation with the support of a trusted person can also provide individuals with greater autonomy and control over their lives. As the father of a son with autism, I keep working to provide new opportunities for people with disabilities and this new law will help many individuals with disabilities live their lives more independently.”

In its current format, guardianship can sometimes hinder the self-determination of disabled New Yorkers as these individuals are limited by guardianship when it comes to decision-making opportunities. This new law legally recognizes Supported Decision-Making Agreements, allowing the decisions made by individuals who need assistance to be formally recognized and ensuring those with intellectual, developmental, cognitive and psychosocial disabilities have more control over their own lives and more independence.
