MEMORANDUM IN SUPPORT OF LEGISLATION

  TITLE OF BILL: An act to amend the labor law, in relation to providing employers with the opportunity to register for emergency alerts from the state of New York public safety alert mass notification system   PURPOSE OR GENERAL IDEA OF BILL: To improve the distribution of emergency information by providing employers with an additional opportunity to register with the state of New York public safety alert mass notification system.   SUMMARY OF PROVISIONS: Section 1 would require the. Department of Labor, in consultation with the Office of Information Technology, to provide every employer in the state with a registration form to voluntary register with the emergency alert notification system. The form would be accompanied by a summary of the benefits of registering for alerts, including a description of how to use the system, and an example for dissemination to workers. Section 2 would provide the effective date.   DIFFERENCE BETWEEN ORIGINAL AND AMENDED VERSION (IF APPLICABLE): N/A   JUSTIFICATION: On Thursday November 15, 2018, New York City, Westchester, Long Island and the surrounding areas were crippled by a snowstorm that many would consider to be minor, having produced only six inches of snow. Stories include commutes typically under an hour in duration taking in excess of six hours. Children were on school buses for up to ten hours. Service on thousands of buses was abruptly canceled, and countless commuters were stranded or delayed with train cancelations or delays. Emergency vehi- cles and plows could not get through the gridlock, further exacerbating the situation. The unexpected nature of the storm was further compounded by the lack of information available to the public. Requests to stay off the roads did not reach commuters and instead employers were sending employees home early, causing even further delays. This bill aims to amplify the distribution of public safety notifica- tions by facilitating employer registration in the emergency alert notification system (alert.ny.gov). The ability to distribute informa- tion through this system can help elevate and manage weather and other emergencies by effectively distributing important and relevant informa- tion to reduce difficulties, delays, and threats to health and safety caused by significant weather events and other emergencies.   LEGISLATIVE HISTORY: 2021-22: S3946-A (Mayer)/No Same As: passed Senate (2021); passed Senate (2022) 2019-20: S5805 (Mayer)/ No Same As: referred to Labor (2019); referred to Labor (2020)   FISCAL IMPLICATIONS: Minimal fiscal impact.   EFFECTIVE DATE: This act would take effect on the thirtieth day after becoming a law.

        AN  ACT  to amend the labor law, in relation to providing employers with
          the opportunity to register for emergency alerts from the state of New
          York public safety alert mass notification system

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1.  The labor law is amended by adding a new section 219-d to
     2  read as follows:
     3    § 219-d. Emergency alert notification system employer registration. 1.
     4  The department, in consultation with the  state  office  of  information
     5  technology  services,  shall  provide every employer in the state with a
     6  registration form which shall be created by the state office of informa-
     7  tion technology services, to voluntarily  register  with  the  emergency
     8  alert  notification  system. Such registration form shall be accompanied
     9  by a summary of the benefits of registering for alerts from the emergen-
    10  cy alert notification system, including a description of how the use  of
    11  the  emergency  alert  system can be utilized to preserve the health and
    12  safety of workers, and an example for dissemination to workers of infor-
    13  mation received from an emergency alert notification.
    14    2. For the purposes of this section, the "emergency alert notification
    15  system" shall mean the state office of information  technology  services
    16  alert system known as alert.ny.gov, or NY-Alert.
    17    §  2.  This  act shall take effect on the thirtieth day after it shall
    18  have become a law.
