  TITLE OF BILL: An act authorizing the town of Hempstead to transfer ownership of certain parkland to the village of Freeport   PURPOSE OR GENERAL IDEA OF BILL:: This bill authorizes Town of Hempstead to convey Guy Lombardo Marina, located in the Village of Freeport, to the Village.   SUMMARY OF PROVISIONS:: Section 1 authorizes the Town of Hempstead to convey Guy Lombardo Marina to the Village of Freeport for use as a public park. Section 2 describes the boundaries and area of the land being trans- ferred. Section 3 provides that the facilities and land being.transferred will be maintained, owned and operated by the village of Freeport and that use of facilities shall continue to be available to all New York State residents. Section 4 provides that when availability of the public parkland is limited, the use of such land or facilities must be determined based on an equitable method that prioritizes use for the general public of New York. Sets limits for park use fees for people who are not residents of the Village of Freeport or the County of Nassau and establishes rules regarding reservation of the park. Section 5 contains the enacting clause.   JUSTIFICATION:: This legislation transfers ownership of Guy Lombardo Marina from the Town of Hempstead to the Village of Freeport. The Village of Freeport has entered into a license agreement with the Town of Hempstead to oper- ate the Town Marina on Guy Lombardo Avenue in Freeport. While the license is 99 years in duration, the Town included a provision that would allow the Marina's ownership to be transferred to the Village. The transfer will enable the consolidation of services, improve efficiency, and create new recreational opportunities for Town and Village resi- dents. The Town and Village believe this transfer is in the best inter- est of the taxpayers of their respective municipalities. The Village intends to improve and rehabilitate the marina, thereby offering addi- tional recreational opportunities for Town and Village residents.   PRIOR LEGISLATIVE HISTORY:: None   FISCAL IMPLICATIONS FOR STATE AND LOCAL GOVERNMENTS:: None   EFFECTIVE DATE:: This act shall take effect immediately after it shall have become law.

        AN ACT authorizing the  town  of  Hempstead  to  transfer  ownership  of
          certain parkland to the village of Freeport

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. (a) Subject to the provisions of  this  act,  the  town  of
     2  Hempstead, county of Nassau, acting through its governing body is hereby
     3  authorized  to  discontinue  the  use of town parkland more particularly
     4  described in section two of this act, and to convey its interest in  the
     5  real  property  to the village of Freeport upon terms agreed upon by the
     6  town of Hempstead and the village of Freeport for use by such village of
     7  Freeport for park and/or recreational purposes, provided, however,  that
     8  such  village of Freeport shall continue to provide access to such park-
     9  land and/or recreational facilities to all  residents  of  the  town  of
    10  Hempstead  and the village shall not enact any fees or charges which are
    11  higher for town residents who are not village residents.
    12    (b) Any revenues received by the town of Hempstead from  the  transfer
    13  shall  be used for capital improvements of existing park or recreational
    14  and/or the acquisition of additional park or recreational facilities.
    15    § 2. The parklands authorized to be conveyed by the town of  Hempstead
    16  in  section  one  of  this  act  are  located,  bounded and described as
    17  follows:
    18    ALL that certain plot, piece or  parcel  of  land  together  with  the
    19  improvements  thereon,  situate,  lying  and  being  in the Incorporated
    20  Village of Freeport, Town of Hempstead, County of Nassau, State  of  New
    21  York  being known and designated as and by Section 62 Block C Lot 102 on
    22  the Land and Tax Map of Nassau County bounded and described  thereon  as
    23  follows:

     1    BEGINNING  at  a  point on the easterly side of So. Grove Street a/k/a
     2  Guy Lombardo Boulevard, distant 343.87 feet southerly  from  the  corner
     3  formed by the intersection of the easterly side of So. Grove Street with
     4  the  southerly  side  of Howard Avenue, which said point of beginning is
     5  also  the  corner formed by the intersection of the easterly side of So.
     6  Grove Street with the southerly side of Anchorage Way;
     7    RUNNING THENCE the following four (4) courses and distances along  the
     8  easterly side of So. Grove Street:
     9    1.  Southerly, 703.92 feet, to an angle point in said easterly side of
    10  So.  Grove Street;
    11    2. Southeasterly, 305.76 feet to another angle point in said  easterly
    12  side of So. Grove Street;
    13    3.  Southeasterly, 403.71 feet to another angle point in said easterly
    14  side of So. Grove Street;
    15    4. Southerly, 470 feet to the northerly line of Tax Lot  151,  Section
    16  62, Block 102 on the said Land and Tax Map of Nassau County;
    17    RUNNING THENCE the following three (3) courses and distances along the
    18  northerly and easterly lines of said Tax Lot 151, Section 62, Block 102:
    19    1.  Easterly, along the northerly line of said tax lot, 63.0 feet to a
    20  point on the easterly line of said tax lot;
    21    2. Southerly, along the easterly line of said tax lot, 249.70 feet  to
    22  an angle point in said easterly line of said tax lot;
    23    3.  Southerly,  still  along  the easterly line of said tax lot, 70.00
    24  feet to The Narrows (Freeport River);
    25    RUNNING THENCE Easterly, along The Narrows, 740 feet more or  less  to
    26  the westerly line of Hudson Bay;
    27    RUNNING  THENCE  along the westerly line of Hudson Bay, 1100 feet more
    28  or less to the southerly line of Tax Lot 103, Section 62, Block C;
    29    THENCE Westerly, along the southerly line of said tax lot, 96.39 feet,
    30  to a point on the westerly line of said tax lot;
    31    RUNNING THENCE Northwesterly, along the said westerly line of said tax
    32  and the westerly lines of Tax Lots 104  and  471,  294.78  feet  to  the
    33  northwesterly side of Anchorage Way;

    45    5. Westerly, along the southerly side of Anchorage Way, 182.87 feet to
    46  another angle point in the southerly side of Anchorage Way;
    47    6. Westerly, along the southerly side of Anchorage Way, 272.96 feet to
    48  another angle point in the southerly side of Anchorage Way; and,
    49    7. Westerly, along the southerly side of Anchorage Way, 110.15 feet to
    50  the point or place of BEGINNING. Containing 39 acres of  land,  more  or
    51  less.
    52    §  3.  The  land to be transferred pursuant to this act and all struc-
    53  tures and facilities situated on such land shall  be  maintained,  owned
    54  and  operated  for  park purposes by the village of Freeport. The use of
    55  such parkland and facilities shall continue to be made available to  the
    56  general  public of the state of New York, including all residents of the

     1  town of Hempstead and the village of Freeport.   Where the  availability
     2  of such facilities is limited, use of such facilities must be determined
     3  by an equitable method.
     4    §  4.   Should the lands described in section two of this act cease to
     5  be used for the purposes described in section one  of  this  act,  those
     6  lands  shall  revert to the town of Hempstead for public park and recre-
     7  ational purposes.
     8    § 5. In the event that the town  of  Hempstead  received  any  funding
     9  support  or  assistance  from  the  federal government for the purchase,
    10  maintenance or improvement of the parklands set forth in section two  of
    11  this  act, the discontinuance and alienation of such parkland authorized
    12  by the provisions of this act shall not occur until the  town  of  Hemp-
    13  stead  has  complied  with  any  federal  requirements pertaining to the
    14  alienation or conversion of parklands, including satisfying  the  secre-
    15  tary of the interior that the alienation or conversion complies with all
    16  conditions which the secretary of the interior deems necessary to ensure
    17  the substitution of other lands shall be equivalent in fair market value
    18  and usefulness to the lands being alienated or converted.
    19    § 6. This act shall take effect immediately.
