  TITLE OF BILL: An act to amend the alcoholic beverage control law, in relation to an exemption for American Legion Post 483, Queens, NY, from the prohibition of alcohol sales within a certain distance from a school   PURPOSE: This bill will allow Rosedale- Laurelton American Legion Post 483 to sell alcohol beverages.   SUMMARY OF PROVISIONS: The bill adds an paragraph e-16 to section 64 of the alcoholic beverage control law to carve out Rosedale-Laurelton VFW Post 483 from the 200 ft. alcoholic beverage control law exemption that is currently barring the establishment from legal authorization to sell alcoholic beverages.   JUSTIFICATION: At current, Rosedale Laurelton American Legion Post 483 is within 200 feet of the Rosedale school. At the heart of the community, this VFW has been doing a great deal of service work in the community and frequently hosts veterans. VFW Post 483 cannot serve alcohol, as they are within 200 feet of Rosedale School.         AN  ACT  to  amend the alcoholic beverage control law, in relation to an
          exemption for American Legion Post 483, Queens, NY, from the  prohibi-
          tion of alcohol sales within a certain distance from a school
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Subdivision 7 of  section  64  of  the  alcoholic  beverage
     2  control  law  is  amended  by  adding  a new paragraph (e-16) to read as
     3  follows:
     4    (e-16) Notwithstanding the provisions of paragraph (a) of this  subdi-
     5  vision,  the  authority  may  issue  a  retail  license  for on-premises
     6  consumption for a premises which shall be within two hundred feet  of  a
     7  building  occupied  exclusively  as a school, church, synagogue or other
     8  place of worship, provided such premises constitutes a premises for  the
     9  sale  of  food  or  beverages  at retail for consumption on the premises
    10  located wholly within the boundaries of the Borough of Queens, county of
    11  Queens, City and State of New York, bounded and described as follows:
    12    All that lot or parcel of land, situate, lying and being in the fourth
    13  yard of the borough of Queens, County of Queens, City of New  York,  and
    14  state  of  New  York,  a  certain  plot of land being lots numbered five
    15  hundred fourteen (514), five hundred fifteen  (515),  and  five  hundred
    16  sixteen  (516),  in block fifteen (15) on a certain map entitled "Map of
    17  Rosedale Terrace," surveyed December 1905, and May 1906, by Evans Bronx,
    18  Jamaica, NY, and filed in the office of the  Clerk  of  said  county  of
    19  Queens,  on the 18th day of February, 1907, and known as Map number 418,
    20  No. 2. said premises being situated on the southeast  corner  of  Brook-

     1  ville Boulevard, and Stratford Avenue, Rosedale, Queens County, New York
     2  being  a  plot with a frontage on Brookville Boulevard, of approximately
     3  sixty (60) feet and a frontage on  Stratford  Avenue,  of  approximately
     4  seventy-four  (74)  feet, irregular. Together with the appurtenances and
     5  all the estate and right of the length of that first  part,  in  and  to
     6  said premises.
     7    Being  and  intended  to be the same premises described in a deed from
     8  George Deutch and Angela Deutch to  Rosedale-Laurelton  American  Legion
     9  Post  483  dated  August  29th, 1934 and recorded with the Queens County
    10  Office of the Register August 31st,  1934  in  the  Queens  County  City
    11  Register File Number 18865.
    12    § 2. This act shall take effect immediately.
