MEMORANDUM IN SUPPORT OF LEGISLATION

  TITLE OF BILL: An act to amend the environmental conservation law, in relation to authorizing hunting big game by rifle in the county of Niagara; and providing for the repeal of such provisions upon expiration thereof   PURPOSE: The purpose of this bill is to allow big game hunting by rifle in Niagara County   SUMMARY OF PROVISIONS: Section 1 of this bill would amend Paragraph a of subdivision 2 of section 11-0907 of the Environmental Conservation Law as added by section 1 of the chapter 243 of the laws of 2017 to allow rifle hunting of big game in Niagara County from the first Saturday after November 15 through the first Sunday after December 7. Section 2 of this bill would amend Paragraph a of subdivision 2 of section 11-0907 of the Environmental Conservation Law, as added by section 3 of chapter 243 of the laws of 2017 to allow rifle hunting of big game in Niagara County from the first Saturday after November 15 through the first Sunday after December 7. Section 3 of this bill provides that the effective date shall be imme- diately.   JUSTIFICATION: Big game hunting, which is a sport that is enjoyed by many throughout the state, includes the hunting of deer and bear. Currently, Niagara is not included in the list of counties that are allowed to use rifles for big game hunting. Also, hunting is a critical conservation tool for the deer and bear population. This legislation, which is at the request of the Niagara County Legisla- ture, would allow for the hunting of big game for the period between November 15th and December 7th using a rifle. Currently many other Coun- ties throughout the state have this allowance under law and Niagara County wishes to be in the same playing field for theidocal sportsmen.   LEGISLATIVE HISTORY: New bill.   FISCAL IMPLICATIONS: None.   EFFECTIVE DATE: This act shall take effect immediately, provided that the amendments to paragraph a of subdivision 2 of section 11-0907 of the environmental conservation law made by section one of this act shall be subject to the expiration and reversion of such paragraph pursuant to section 13 of chapter 600 of the laws of 1993, as amended, when upon such date the provisions of section two of this act shall take effect.

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1.  Paragraph  a  of  subdivision 2 of section 11-0907 of the
     2  environmental conservation law is amended by adding a new  item  (q)  to
     3  read as follows:
     4  (q) The county of       Deer, the first Saturday   Pistol, shotgun,
     5  Niagara except          after November 15          crossbow, muzzle
     6  within the city of      through first Sunday       loading firearm,

    11    §  2.  Item  (f) of paragraph a of subdivision 2 of section 11-0907 of
    12  the environmental conservation law, as amended by section 2  of  chapter
    13  230 of the laws of 2023, is amended to read as follows:
    14  (f) Southern tier,        Deer, first              Pistol, shotgun,
    15  central and Western       Monday after November    crossbow,
    16  region, except those      15 through first         muzzle loading
    17  counties or portions      Tuesday after            firearm or
    18  thereof listed in         December 7               long bow only

    23    §  3.  Paragraph a of subdivision 2 of section 11-0907 of the environ-
    24  mental conservation law is amended by adding a new item (o) to  read  as

    20    a.  the  amendments to paragraph a of subdivision 2 of section 11-0907
    21  of the environmental conservation law made by section one  of  this  act
    22  shall  be  subject  to  the  expiration  and reversion of such paragraph
    23  pursuant to section 13 of chapter 600 of the laws of 1993, as amended;
    24    b. the amendments to item (f) of  paragraph  a  of  subdivision  2  of
    25  section  11-0907  of  the environmental conservation law made by section
    26  two of this act shall be subject to the expiration and reversion of such
    27  item pursuant to paragraph d of section 5 of chapter 152 of the laws  of
    28  2020, as amended;
    29    c.  sections  three  and  four  of this act shall take effect upon the
    30  expiration and reversion of paragraph a  of  subdivision  2  of  section
    31  11-0907 of the environmental conservation law, as provided in section 13
    32  of chapter 600 of the laws of 1993, as amended; and
    33    d.  nothing  contained  in this act shall be construed so as to extend
    34  the provisions of this act beyond October 1, 2026, when upon  such  date
    35  this  act  shall  expire  and  the  provisions contained herein shall be
    36  deemed repealed.
