  TITLE OF BILL: An act to amend the general business law, in relation to personal infor- mation being removed from rental vehicles   PURPOSE OR GENERAL IDEA OF BILL: The purpose of the bill is to include in a rental agreement that any information uploaded to a vehicle by a renter, must be removed prior to returning the vehicle.   SUMMARY OF PROVISIONS: Section 1: Section 396-z of the general business law is amended by adding a new subdivision 17 that requires all rental vehicle companies to include a clause, within rental agreements, that instructs all renters to remove their personal information from vehicles before returning them and allows the option to place a decal within the vehicle that reminds renters of this clause. Section 2: This act shall take effect on the thirtieth day after it shall have become law.   JUSTIFICATION: Modem vehicles tend to include applications and software that allows you to upload your personal information in order to make calling, music playing, and other processes easier while driving. Although this is useful for the renter, it leaves their personal information vulnerable to the next renter. This bill protects consumers by including a clause in all car rental agreements that requires renters to remove their personal information from the rented vehicles before their return.   PRIOR LEGISLATIVE HISTORY: New bill.   FISCAL IMPLICATIONS FOR STATE AND LOCAL GOVERNMENTS: TBD.   EFFECTIVE DATE: This act shall take effect on the thirtieth day after it shall have become law.

        AN ACT to amend the general business law, in relation to personal infor-
          mation being removed from rental vehicles

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1.  Section  396-z  of the general business law is amended by
     2  adding a new subdivision 17 to read as follows:
     3    17. A rental vehicle company shall:
     4    (a) include in the car  rental  agreement  a  clause  instructing  the
     5  renter to remove their personal information from vehicles before return-
     6  ing the vehicle.
     7    (b)  have  the  option  to  place  inside  all rental vehicles a decal
     8  instructing renters to remove their personal information from the  vehi-
     9  cle before returning the vehicle.
    10    §  2.  This  act shall take effect on the thirtieth day after it shall
    11  have become a law; provided however that the amendments to section 396-z
    12  of the general business law made  by  section  one  of  this  act  shall
    13  survive  the  expiration  and  reversion  of such section as provided in
    14  subdivision (a) of section 4 of chapter 109 of  the  laws  of  2018,  as
    15  amended.
