  TITLE OF BILL: An act to amend the county law, in relation to reestablishing the office of coroner in the county of Oswego and removing the powers and duties of coroners from the district attorney in such county and allowing Oswego county to appoint a coroner; and to repeal chapter 369 of the laws of 1920, abolishing the office of coroner in the county of Oswego, and providing that the powers and duties of coroners in such county shall hereafter be exercised by the district attorney, relating thereto   PURPOSE OR GENERAL IDEA OF BILL: To establish the office of the coroner in Oswego county, and to remove the duties of coroner from the district attorney   SUMMARY OF PROVISIONS: Section 1. Reestablishes the office of coroner within the county of Oswego, and removes those duties from the office of the district attor- ney Section 2. Repeals chapter 369 of the laws of 1920, which abolished the office of the Oswego county coroner Section 3. Amends Section 400 of the county law by adding a new subdivi- sion 3-c which establishes the office of coroner in the county of Oswe- go. The coroner shall be appointed by the county legislature. Section 4. Effective Date   DIFFERENCE BETWEEN ORIGINAL AND AMENDED VERSION (IF APPLICABLE): The amendment clarifies that this bill shall only apply to Oswego County   JUSTIFICATION: This legislation was introduced at the request of Oswego County.   PRIOR LEGISLATIVE HISTORY: New Bill   FISCAL IMPLICATIONS FOR STATE AND LOCAL GOVERNMENTS: None to the State   EFFECTIVE DATE: Immediately

          tee on  Local  Governments  --  committee  discharged,  bill  amended,
          ordered reprinted as amended and recommitted to said committee
 
        AN ACT to amend the county law, in relation to reestablishing the office
          of  coroner in the county of Oswego and removing the powers and duties
          of coroners from the district attorney in  such  county  and  allowing
          Oswego  county  to appoint a coroner; and to repeal chapter 369 of the
          laws of 1920, abolishing the office of coroner in the county of  Oswe-
          go, and providing that the powers and duties of coroners in such coun-
          ty  shall  hereafter  be  exercised by the district attorney, relating
          thereto
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1.  This  act  reestablishes the office of coroner within the
     2  county of Oswego and removes such powers and duties from the  office  of
     3  the district attorney and places it with the office of the coroner with-
     4  in the county of Oswego.
     5    § 2. Chapter 369 of the laws of 1920, abolishing the office of coroner
     6  in  the  county  of  Oswego, and providing that the powers and duties of
     7  coroners in such county shall hereafter be  exercised  by  the  district
     8  attorney, is REPEALED.
     9    § 3. Section 400 of the county law is amended by adding a new subdivi-
    10  sion 3-c to read as follows:
    11    3-c.  Coroner  in Oswego county. The office of coroner is hereby rees-
    12  tablished in the county of Oswego. The powers and duties of the  coroner
    13  previously held by the district attorney are now placed in the office of
    14  the  coroner of the county of Oswego. Such coroner shall be appointed by
    15  the county legislature. The provisions of this section  shall  not  have
    16  the  effect  under  section ten of the municipal home rule law to permit
    17  any county, other than Oswego county as herein  prescribed,  to  change,
    18  amend or supersede, by local law, any provisions of this chapter.
    19    §  4.  This  act shall take effect immediately; provided however, that
    20  the district attorney in Oswego county shall continue to  serve  as  the
    21  coroner until such time as a coroner is appointed.
