  TITLE OF BILL: An act to amend the public officers law, in relation to qualifications for holding the office of code enforcement officer of the city of Auburn   PURPOSE OR GENERAL IDEA OF BILL: To facilitate the hiring of code enforcement personnel in the City of Auburn. SUMMARY OF PROVISIONS: Section 1: adds a new subdivision to Section 3 of the public officers law to allow the city of Auburn to hire code enforcement officers who live in Cayuga County or adjoining counties. Section 2: Sets the effective date.   JUSTIFICATION: This bill, introduced at the request of the City of Auburn, amends the public officers law to allow more flexibility in residency requirements for the purpose of hiring code enforcement officers in said city.   PRIOR LEGISLATIVE HISTORY: This is a new bill.   FISCAL IMPLICATIONS FOR STATE AND LOCAL GOVERNMENTS: None.   EFFECTIVE DATE: This bill is effective immediately.

        AN  ACT  to amend the public officers law, in relation to qualifications
          for holding the office of code enforcement  officer  of  the  city  of
          Auburn
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Section 3 of the public officers law is amended by adding a
     2  new subdivision 75 to read as follows:
     3    75. In the city of Auburn, in the county of Cayuga, the provisions  of
     4  this section requiring a person to be a resident of the political subdi-
     5  vision or municipal corporation of the state for which such person shall
     6  be  chosen or within which such person's official functions are required
     7  to be exercised, shall not prevent such person from holding  the  office
     8  of  code  enforcement  officer of the city of Auburn, provided that such
     9  person resides in Cayuga county, or in an adjoining  county  within  the
    10  state  of  New  York;  provided, however that any person performing such
    11  functions of code enforcement officer in any other  city  in  the  state
    12  shall be a resident of such city unless otherwise provided by law.
    13    § 2. This act shall take effect immediately.
