TITLE OF BILL:
An act to amend part C of chapter 97 of the laws of 2011, amending the
state finance law and other laws relating to providing certain central-
ized service to political subdivisions and extending the authority of
the commissioner of general services to aggregate purchases of energy
for state agencies and political subdivisions, in relation to the effec-
tiveness thereof
 
PURPOSE:
To extend the authority of local governments to purchase technology
products and software, security, law enforcement and disaster relief
from the Federal General Service Administration; authorizes local
governments to utilize and purchase from county contracts for
construction trades/ service-related contracts; and make purchases
utilizing the Office of General Services (OGS) contracts.
 
SUMMARY:
Section 1 Amends Section 103 (1-b), Section 103 (1-b) and Section 104 of
the General Municipal Law by extending them for five years to July 31,
2029.
 
JUSTIFICATION:
Municipalities utilize cooperative contracting authority on a regular
basis. By purchasing commonly used goods and services, school districts,
BOCES, cities, counties, towns, villages, and fire districts can most
effectively manage taxpayer funds by taking advantage of the lower pric-
es larger contracts offer, while also reducing the administrative burden
of separately contracting for each of these items individually.
Losing the ability to utilize these contracts would have an immediate
and negative impact on municipalities and their taxpayers by forcing
thousands of municipalities to individually enter the procurement proc-
ess for commonly needed contracts that are already available.
 
PRIOR LEGISLATIVE HISTORY:
These provisions were previously extended by part GG of chapter 55 of
the laws of 2019.
 
FISCAL IMPLICATIONS:
None to the state.
 
EFFECTIVE DATE:
This act shall take effect immediately.

AN ACT to amend part C of chapter 97 of the laws of 2011, amending the
state finance law and other laws relating to providing certain
centralized service to political subdivisions and extending the
authority of the commissioner of general services to aggregate
purchases of energy for state agencies and political subdivisions, in
relation to the effectiveness thereof
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Section 9 of subpart A of part C of chapter 97 of the laws
2 of 2011, amending the state finance law and other laws relating to
3 providing certain centralized service to political subdivisions and
4 extending the authority of the commissioner of general services to
5 aggregate purchases of energy for state agencies and political subdivi-
6 sions, as amended by section 3 of part GG of chapter 55 of the laws of
7 2019, is amended to read as follows:
8 § 9. This act shall take effect immediately, provided, however that:
9 1. sections four, five, six and seven of this act shall expire and be
10 deemed repealed July 31, [2024] 2029;
11 2. the amendments to subdivision 4 of section 97-g of the state
12 finance law made by section two of this act shall survive the expiration
13 and reversion of such subdivision as provided in section 3 of chapter
14 410 of the laws of 2009, as amended;
15 3. sections four, five, six and seven of this act shall apply to any
16 contract let or awarded on or after such effective date;
17 4. section one of this act shall expire and be deemed repealed July
18 31, 2029.
19 § 2. This act shall take effect immediately.
