Ren §265.50 to be §265.46, amd §400.00, Pen L; add Art 35 §847, Exec L
 
Directs that statewide resources and information relating to safe storage of firearms, child access prevention and firearm violence prevention and information on county and local specific laws and regulations related to child access prevention and the safe storage of firearms shall be provided to individuals at the time of issuance of a firearm license; directs the commissioner of the division of criminal justice services to develop and implement a public awareness campaign on the safe storage of firearms, rifles and shotguns and child access and prevention.

TITLE OF BILL:
An act to amend the penal law and the executive law, in relation to the
safe storage of firearms and child access prevention
 
PURPOSE OR GENERAL IDEA OF BILL:
To require upon issuance of a license that information be provided
regarding child access prevention, firearm violence prevention, and
information on county and local specific laws. Additionally the bill
directs DCJS to do a public awareness campaign on safe storage and child
access prevention.
 
SUMMARY OF PROVISIONS:
Section 1: amends the penal law requiring issuance of a license that
information be provided regarding child access prevention, firearm
violence prevention, and information on county and local specific laws.
Section 2: would renumber sections of the penal law.
Section 3: directs the commissioner of the Division of Criminal Justice
Servies to conduct a public awareness campaign to provide education on
safe storage of firearms and child access prevention.
Section 4: effective date.
 
DIFFERENCE BETWEEN ORIGINAL AND AMENDED VERSION (IF APPLICABLE):
The amendment would make the information DCJS collects sharable, and any
agencies can reach out to request the material for dissemination.
 
JUSTIFICATION:
While New York has made important strides in passing gun-safety laws
related to the safe storage of firearms and child access prevention,
public awareness of the details of these laws remains comparatively low.
Increasing public awareness of gun-safety laws is especially relevant
for parents and parental guardians of students in school districts
across the state. Having up-to-date information can create safer commu-
nities and keep parents and parental guardians informed of gun-safety
laws pertinent to their daily lives.

AN ACT to amend the penal law and the executive law, in relation to the
safe storage of firearms and child access prevention
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Paragraph (c) of subdivision 18 of section 400.00 of the
2 penal law, as amended by chapter 371 of the laws of 2022, is amended and
3 a new paragraph (d) is added to read as follows:
4 (c) any other information necessary to ensure such licensee is aware
5 of their responsibilities as a license holder[.]; and
6 (d) statewide resources and information relating to safe storage of
7 firearms, child access prevention and firearm violence prevention as
8 well as information on county and local specific laws and regulations
9 related to child access prevention and the safe storage of firearms.
10 § 2. Section 265.50 of the penal law, as amended by chapter 133 of the
11 laws of 2019, is renumbered section 265.46.
12 § 3. Article 35 of the executive law is amended by adding a new
13 section 847 to read as follows:
14 § 847. Public awareness of safe storage of firearms. 1. The commis-
15 sioner shall develop and implement a public awareness campaign to
16 educate the public on the safe storage of firearms, rifles and shotguns
17 and child access and prevention. The public awareness campaign shall
18 include, but not be limited to, educational materials, resources and
19 information related to New York state child access prevention laws and
20 laws relating to the safe storage and transport of firearms, rifles and
21 shotguns including sections 265.45, 265.46, and 400.00 of the penal law,
22 available methods for the safe storage of firearms, rifles and shotguns
23 designed to prevent child access, firearm violence prevention resources,
24 and county and local specific laws and regulations related to child
25 access prevention and safe storage of firearms, rifles and shotguns.

1 2. The commissioner shall make the educational materials developed for
2 use in this public awareness campaign readily shareable in a digital
3 format and make the materials available on the public facing portion of
4 the division's website. The commissioner shall make the educational
5 materials readily available to any agency who requests such educational
6 materials for dissemination.
7 3. On or before July first, two thousand twenty-five, and each July
8 first thereafter, the division shall update, as necessary, the educa-
9 tional materials developed pursuant to subdivision one of this section
10 and make available and disseminate the updated materials pursuant to
11 subdivision two of this section.
12 § 4. This act shall take effect immediately.
