  TITLE OF BILL: An act to amend the alcoholic beverage control law, in relation to providing for a license to sell liquor at retail for consumption on certain premises   PURPOSE OR GENERAL IDEA OF BILL: To amend the Alcoholic Beverage Control Law allowing the State Liquor Authority to issue a license to a HOTEL located at 428 S 5th STREET, BROOKLYN NY 11211 with the entrance located on SOUTH 5th STREET, just southwest of HEWES STREET.   SUMMARY OF SPECIFIC PROVISIONS: This bill amends subdivision 7 of section 64 of the Alcoholic Beverage Control Law by adding a new paragraph which allows a license for on premises consumption of alcoholic beverages at restaurants located with- in the building which serves as a hotel but is within 200 feet of a school   JUSTIFICATION: The new hotel will include facilities which will apply for licenses pursuant to the ABC Law. Since that entrance is within 200 feet of BNYOS CHAYIL school, legislation allowing an exemption is required. The new hotel has been operating for 1.5years and   PRIOR LEGISLATIVE HISTORY: New bill.   FISCAL IMPLICATIONS: None to the State.   EFFECTIVE DATE: This act shall take effect immediately.

        AN ACT to amend the alcoholic  beverage  control  law,  in  relation  to
          providing  for  a  license to sell liquor at retail for consumption on
          certain premises
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1.  Subdivision  7  of  section  64 of the alcoholic beverage
     2  control law is amended by adding a  new  paragraph  (e-16)  to  read  as
     3  follows:
     4    (e-16)  Notwithstanding the provisions of paragraph (a) of this subdi-
     5  vision, the  authority  may  issue  a  retail  license  for  on-premises
     6  consumption  for  a  premises  which shall be located within two hundred
     7  feet of a building occupied as a  school,  church,  synagogue  or  other
     8  place  of  worship, provided such premises constitute a premises for the
     9  sale of food or beverages at retail  for  consumption  on  the  premises
    10  located  wholly  within  the  boundaries  of  the county of Kings in the
    11  Borough of Brooklyn in the city of New York, bounded  and  described  as
    12  follows:
    13    ALL  THAT  CERTAIN  PLOT,  piece of parcel of land, situate, lying and
    14  being in the Borough of Brooklyn, County of Kings and State of New York,
    15  bounded and described as follows:
    16    BEGINNING AT A POINT on the corner of easterly side  of  Hewes  Street
    17  and the southerly side of South 5th Street;
    18    RUNNING  THENCE  easterly  the  southerly side of South 5th Street 101
    19  feet 7 inches (101 feet 6 inches tax map);
    20    THENCE southerly parallel with Hewes Street  100  feet  2  1/8  inches
    21  description (100 feet 0 inches tax map);
    22    THENCE  westerly parallel with South 5th Street 101 feet 7 inches (101
    23  feet 6 inches tax map) to the easterly side of Hewes Street;
    24    THENCE northerly along the easterly side of Hewes Street  100  feet  2
    25  1/8  inches  (100  feet  0  inches description) to the southerly side of
    26  South 5th Street to the point or place of BEGINNING.
    27    § 2. This act shall take effect immediately.
