  TITLE OF BILL: An act to amend the vehicle and traffic law, in relation to the defi- nition of class two bicycles with electric assist   PURPOSE OR GENERAL IDEA OF BILL: To amend the definition of class two electric bicycles to align with the allowable speed limit of this type of bicycle,   SUMMARY OF PROVISIONS: Section one amends the definition of "class two bicycle with electric assist" in subdivision b section 102c of the vehicle traffic law to provide that it refers to a bicycle with electric assist having an elec- tric motor that may be used exclusively to propel such bicycle, and that is not capable of providing assistance when such bicycle reaches a speed of twenty-eight miles per hour. Section two provide the effective date.   JUSTIFICATION: Under current law, New York defines a class two electric bicycle as a bicycle having an electric motor that may be used exclusively to propel the bicycle, and that it's not capable of providing assistance to the rider when such bicycle reaches a speed of twenty miles per hour. The class two electric bikes currently on the market can reach a maximum speed of twenty-eight miles per hour. This legislation amends the defi- nition of class two electric bicycles to provide that it relates to bicycles not capable of aiding the rider once it reaches twenty-eight miles per hour. It will simply correct a discrepancy in the definition and does not pertain to the speed limit of roadways upon which this type of electric bicycle may ride. The bill is necessary to align with indus- try standards and to avoid any unnecessary confusion by electric bicycle riders and sellers in our state.   PRIOR LEGISLATIVE HISTORY: A2660 of 2023 and 2024, referred to transportation A.9160 of 2021 and 2022, referred to transportation.   FISCAL IMPLICATIONS: None   EFFECTIVE DATE: This act shall take effect immediately.
