TITLE OF BILL:
An act to amend the energy law, in relation to requiring new buildings
where new parking is provided to have electric vehicle charging infras-
tructure; and to repeal certain provisions of the executive law relating
to certain standards in the New York state uniform fire prevention and
building code
 
PURPOSE OR GENERAL IDEA OF BILL:
The purpose of this bill is to effectuate an amendment to Chapter 643 of
the laws of 2024, relating to standards for electric vehicle (EV) charg-
ing infrastructure in new construction and off-street parking.
 
SUMMARY OF PROVISIONS:
Section one:
*Repeals Subdivision 17-a of Section 378 of the executive law, as added
by Chapter 643 of the laws of 2024.
Section two:
*Adds a new Subdivision 9 to Section 11-104 of the energy law, outlining
updated standards for EV infrastructure in newly constructed buildings
that include dedicated off-street parking.
*Defines "electric vehicle ready infrastructure" and "electric vehicle
charging station."
*Requires new buildings with off-street parking to include EV-ready
infrastructure and charging stations in compliance with minimum stand-
ards established by the state fire prevention and building code council.
*Establish factors the state fire prevention and building code council
shall consider when establishing such standards.
*Mandates clear signage for EV-ready parking spaces and charging
stations.
Section three establishes the effective date.
 
JUSTIFICATION:
This chapter makes amendments that relocates EV infrastructure standards
from the executive law to the energy law, ensuring alignment with state
energy objectives and the goals of Section 19-0306-b of the Environ-
mental • Conservation Law. The bill provides clarity for stakeholders
and offers flexibility for municipalities and building developers by
considering geographic and technical constraints. By emphasizing equity
and accessibility, the bill ensures that EV infrastructure supports the
state's clean energy transition while addressing the needs of diverse
communities.

EFFECTIVE DATE:
This act shall take effect immediately; provided, however, that section
one of this act shall take effect on December 31, 2026, coinciding with
the adoption of updated building codes.
