NEW YORK STATE ASSEMBLY MEMORANDUM IN SUPPORT OF LEGISLATION submitted in accordance with Assembly Rule III, Sec 1(f)

BILL NUMBER: A8822
SPONSOR: Kay

TITLE OF BILL:
An act to amend the military law, in relation to authorizing additional
paid leave for public employees who are absent on military duty

PURPOSE:
Authorizes additional paid leave for public employees who are absent
while performing ordered military duty.

SUMMARY OF PROVISIONS:
Amends paragraph (a) of subdivision 5 of section 242 of the military
law, as amended by chapter 406 of the laws of 2017, to read as follows:
(a) Every public officer or employee shall be paid their salary or other
compensation as such public officer or employee for any and all periods
of absence while engaged in the performance of ordered military duty,
and while going to and returning from such duty, not exceeding a total
of sixty days or fifty-two working days, whichever is greater, in any
one calendar year and not exceeding sixty days or fifty-two working
days, whichever is greater, in any one continuous period of such
absence.

JUSTIFICATION:
Currently, state law allows public employees to receive 30 days of paid
leave a year for military service. The courageous New Yorkers who work
as public servants and answer the call of duty should be fairly compen-
sated for their military service.
