TITLE OF BILL:
 
An act to amend the correction law, in relation to preventing the over-
detention of persons due to an outstanding warrant
 
 
PURPOSE OR GENERAL IDEA OF BILL:;
 
The purpose of this bill is to prevent over detention due to outstanding
warrants.
 
 
SUMMARY OF PROVISION:
 
Section 1: amends the correction law by adding a new section 12 that
prohibits the holding of an individual for more than 3 days if they
would not be otherwise held if not for an outstanding warrant.
 
Section 2: sets the effective date.
 
 
JUSTIFICATION:
 
Despite the constitution making it illegal to,detain inmates for more
time than necessary, the criminal justice system has yet to enforce a
more just and fair solution to dealing with inmates that are held longer
than required. An outstanding warrant from a separate jurisdiction
should not be an eligible excuse to hold a person longer than necessary.
This bill would simply make it illegal to do so.
