MEMORANDUM IN SUPPORT OF LEGISLATION
submitted in accordance with Assembly Rule III, Sec 1(f)   BILL NUMBER: A2723 SPONSOR: Paulin
  TITLE OF BILL: An act to amend chapter 222 of the laws of 1994, constituting the family protection and domestic violence intervention act of 1994, in relation to the effectiveness thereof   PURPOSE: To remove the repeal date for section 140.10(4) of the criminal proce- dure law mandating arrest where an officer has reasonable cause to believe that domestic violence or other specified incident has occurred.   SUMMARY OF PROVISIONS: Section one of the bill removes the repeal date for 140.10(4) of the criminal procedure law. Section two sets forth the effective date.   JUSTIFICATION: Domestic violence is a dangerous and prevalent form of abuse. Under the current law, police responding to calls involving a family offense are required to arrest the perpetrator if they have reasonable cause to believe a family offense or violation of an order of protection has occurred. This provision prevents risk of further or continued abuse after law enforcement leaves the scene. Currently, the provision mandating arrest is set to expire on September 1, 2025. This bill would make mandatory arrest for a family offense or violation of related order of protection permanent.   LEGISLATIVE HISTORY: New bill.   FISCAL IMPLICATIONS: None.   EFFECTIVE DATE: This act shall take effect immediately.
