  TITLE OF BILL: An act to amend the general business law, in relation to removing deal- ers of ammunition from certain provisions regarding the use of certain merchant category-codes by payment card networks   PURPOSE OR GENERAL IDEA OF BILL: The purpose of this bill is to effectuate an amendment to Chapter 430 of the laws of 2024 (approval memo 10) related to requiring payment card networks to use certain merchant category-codes for firearm merchants.   SUMMARY OF PROVISIONS: Section one removes the definition of "dealer of ammunition" to clarify that the bill covers "dealers of firearms" as they are defined in the penal law. Section two is the effective date.   JUSTIFICATION: This chapter makes technical amendments to clarify Chapter 430 of the laws of 2024.   PRIOR LEGISLATIVE HISTORY: This bill is a chapter amendment to Chapter 430 of the laws of 2024.   FISCAL IMPLICATIONS FOR STATE AND LOCAL GOVERNMENTS: None.   EFFECTIVE DATE: This act shall take effect on the same date and in the same manner as a chapter of the laws of 2024 amending general business law relating to requiring payment card networks to use certain merchant category-codes for firearms merchants, as proposed in legislative bills numbers S.8479-A and A.9862-A takes effect.

        AN ACT to amend the general business law, in relation to removing  deal-
          ers of ammunition from certain provisions regarding the use of certain
          merchant category-codes by payment card networks
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Subdivisions 1 and 2 of section 529-a of the general  busi-
     2  ness law, as added by a chapter of the laws of 2024 amending the general
     3  business  law relating to requiring payment card networks to use certain
     4  merchant category-codes for firearm merchants, as proposed  in  legisla-
     5  tive  bills  numbers  S.  8479-A  and  A. 9862-A, are amended to read as
     6  follows:
     7    1. For the purposes of this section, the following  terms  shall  have
     8  the following meanings:
     9    (a)  ["Dealer of ammunition" means any person who engages in the busi-
    10  ness of purchasing, selling or keeping ammunition in this state.
    11    (b)] "Dealer of firearms" means a gunsmith or dealers in  firearms  in
    12  this  state  licensed  pursuant  to section 400.00 of the penal law, for
    13  which the highest sales value  is,  or  is  expected  to  be,  from  the
    14  combined  sale  in New York of firearms, firearm accessories, or ammuni-
    15  tion, as stated by the business to its merchant acquirer in the ordinary
    16  course of business.
    17    [(c)] (b) "Firearm" has the same meaning as that term  is  defined  in
    18  subdivision three of section 265.00 of the penal law.
    19    2.  (a)  On  or  before November first, two thousand twenty-four, each
    20  payment card network shall make the merchant category-code for  firearms
    21  and  ammunition businesses established by the international organization
    22  for standardization on September ninth, two thousand twenty-two,  avail-

     1  able for merchant acquirers that provide payment services for dealers of
     2  [ammunition or dealers of] firearms.
     3    (b)  On  and  after May first, two thousand twenty-five, each merchant
     4  acquirer shall assign to each  dealer  of  [ammunition  and  dealer  of]
     5  firearms in this state the merchant category-code for firearms and ammu-
     6  nition  businesses  established  by  the  international organization for
     7  standardization on September ninth, two thousand twenty-two.
     8    § 2. This act shall take effect on the  same  date  and  in  the  same
     9  manner  as  a  chapter of the laws of 2024 amending the general business
    10  law relating to requiring payment card networks to use certain  merchant
    11  category-codes  for  firearm merchants, as proposed in legislative bills
    12  numbers S. 8479-A and A. 9862-A, takes effect.
