  TITLE OF BILL: An act amend the social services law, in relation to making technical changes to certain provisions of such law; to repeal sections 2, 3, 4 and 5 of a chapter of the laws of 2024 amending the social services law relating to requiring maintained records for certain children to include whether they have a developmental disability; and conducting a study on the number of children in foster care who have a developmental disabili- ty; as proposed in legislative bills numbers S. 8679-A and A. 8846-A, in relation to conducting a study to determine the number of children in foster care and who have been diagnosed with a developmental disability; and to amend a chapter of the laws of 2024 amending the social services law relating to requiring maintained records for certain children to include whether they have a developmental disability; and conducting a study on the number of children in foster care who have a developmental disability, as proposed in legislative bills numbers S. 8679-A and A. 8846-A, in relation to the effectiveness thereof   PURPOSE: The purpose of this bill is to update current law related to conducting a study on the number of children placed in foster care who have been diagnosed with a developmental disability.   SUMMARY OF PROVISIONS: This bill would repeal existing study and reporting requirements related to children in foster care who have been diagnosed with a developmental disability, make technical amendments to the statute to ensure gender- neutral terminology, and extend the effective date to one year following enactment.   JUSTIFICATION: Chapter 663 of the Laws of 2024 required the commissioners of the Office of Family and Child Services and the Office For People with Develop- mental Disabilities to conduct a study on the number of children in foster care who have been diagnosed with a developmental disability and report relevant information to the governor and legislature. However, amendments were necessary to eliminate the study and reporting require- ments while ensuring relevant entities maintain records regarding this vulnerable population. The effective date was also extended to provide the Office of Children and Family Services with adequate time for imple- mentation.   LEGISLATIVE HISTORY: This is new legislation.   FISCAL IMPLICATIONS: To be determined.   EFFECTIVE DATE: This act shall take effect immediately provided, however, that sections one and two of this act shall take effect on the same date and in the same manner as a chapter of the laws of 2024 relating to requiring main- tained records for certain children to include whether they have a developmental disability; and conducting a study on the number of chil- dren in foster care who have a developmental disability, as proposed in legislative bills numbers S. 8679-A and A. 8846-A, takes effect.

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1.  Paragraphs (b) and (c) of subdivision 1 of section 372  of
     2  the  social  services  law,  as amended by a chapter of the laws of 2024
     3  amending the social services  law  relating  to  requiring    maintained
     4  records  for  certain  children  to include whether they have a develop-
     5  mental disability; and conducting a study on the number of  children  in
     6  foster care who have a developmental disability, as proposed in legisla-
     7  tive  bills  numbers  S.  8679-A  and  A. 8846-A, are amended to read as
     8  follows:
     9    (b) [his or her] the child's sex and  date  and  place  of  birth,  if
    10  ascertainable, or [his or her] the child's apparent age;
 
         EXPLANATION--Matter in italics (underscored) is new; matter in brackets
                              [ ] is old law to be omitted.

     1    (c)  the  full  and true names and places of birth of [his or her] the
     2  child's parents, and [their] such parents' actual residence  if  living,
     3  or  [their]  such parents' latest known residence, if deceased or where-
     4  abouts unknown and the name and actual residence  of  any  other  person
     5  having  custody  of  the  child, as nearly as the same can reasonably be
     6  ascertained;
     7    § 2. Sections 2, 3, 4 and 5 of a chapter of the laws of 2024  amending
     8  the  social  services  law  relating to requiring maintained records for
     9  certain children to include whether they have a developmental  disabili-
    10  ty;  and conducting a study on the number of children in foster care who
    11  have a  developmental  disability,  as  proposed  in  legislative  bills
    12  numbers S. 8679-A and A. 8846-A, are REPEALED.
    13    §  3.  Section  6 of a chapter of the laws of 2024 amending the social
    14  services law relating to requiring maintained records for certain  chil-
    15  dren  to  include  whether  they  have  a  developmental disability; and
    16  conducting a study on the number of children in foster care who  have  a
    17  developmental  disability,  as  proposed in legislative bills numbers S.
    18  8679-A and A.  8846-A, is renumbered section 2 and amended  to  read  as
    19  follows:
    20    §  2. This act shall take effect [immediately] one year after it shall
    21  have become a law.
    22    § 4. This act shall take effect immediately; provided,  however,  that
    23  sections  one and two of this act shall take effect on the same date and
    24  in the same manner as a chapter of the laws of 2024 relating to  requir-
    25  ing maintained records for certain children to include whether they have
    26  a  developmental  disability;  and  conducting  a study on the number of
    27  children in foster care who have a developmental disability, as proposed
    28  in legislative bills numbers S. 8679-A and A. 8846-A, takes effect.
