TITLE OF BILL:
An act to amend the alcoholic beverage control law, in relation to a
license to sell liquor at retail for consumption on certain premises
 
PURPOSE OR GENERAL IDEA OF BILL:
The purpose of this bill is to provide the Silk Factory in the City of
Newburgh an exemption from the 200-foot rule so they can use their Wash-
ington Street entrance to obtain a liquor license.
 
SUMMARY OF PROVISIONS:
§ 1 adds paragraph (e-15) to subdivision 7 of section 64-a of the alco-
holic beverage control law. This paragraph outline the metes and bounds
of the establishment, which are within 200 feet of a church and provide
an exemption to obtain a liquor license.
§ 2 is the effective date.
 
JUSTIFICATION:
Under state law, no restaurant or bar may serve liquor within 200 feet
of a church or house of worship. Currently, the Silk Factory cannot use
their Washington Street entrance and serve alcohol because they are
located within 200 feet of Sacred Heart Church.
Sacred Heart Church has given its approval to the Silk Factory to seek
this exemption and utilize their Washington Street entrance. The
exemption is necessary to increase convenience and allow the establish-
ment to modify their current layout.

EFFECTIVE DATE:
This act shall take effect immediately.

AN ACT to amend the alcoholic beverage control law, in relation to a
license to sell liquor at retail for consumption on certain premises
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Subdivision 7 of section 64 of the alcoholic beverage
2 control law is amended by adding a new paragraph (e-15) to read as
3 follows:
4 (e-15) Notwithstanding the provisions of paragraph (a) of this subdi-
5 vision, the authority may issue a retail license for on-premises
6 consumption for a premises which shall be located within two hundred
7 feet of a building occupied as a church, synagogue or other place of
8 worship, provided such premises constitute a premises for the sale of
9 food or beverages at retail for consumption on the premises located
10 wholly within the boundaries of the city of Newburgh, county of Orange,
11 bounded and described as follows:
12 All that plot, piece, or parcel of land situate, lying and being in
13 the City of Newburgh, Orange County, New York, bounded and described as
14 follows:
15 Beginning at a point on the southerly side of Washington Street, said
16 point being in the division line between Lot 266 on the west and lands
17 now or formerly Agnello (Lot 267) Liber 6001 Page 317 on the east, and
18 running; thence
19 1. Along lands now or formerly Agnello (Lot 267), S. 04°-53'-32" W.
20 100.00' to a point in Lot 209; thence
21 2. Along Lots 209 and 210, N. 85°-13'-58" W. 50.00' to a point in Lot
22 264; thence
23 3. Along Lot 264, N. 04°-53'-32" E. 100.00' to a point on the souther-
24 ly side of Washington Street; thence
