TITLE OF BILL:
An act to amend the criminal procedure law, in relation to granting
peace officer status to certain security officers employed by Highland
Hospital
 
PURPOSE:
To confer peace officer status on members of Highland Hospital security.
 
SUMMARY OF PROVISIONS:
Section 1: Grants peace officer, status to security officers of Highland
Hospital or its subsidiaries when such officers are acting within the
meets and bounds of Highland Hospital including campuses and facilities;
and also for the purpose of transporting an individual who has been
arrested and no local law enforcement officer is available for trans-
porting such individual in a timely manner; Peace officers will also
have power to detain an individual for a reasonable period of time while
awaiting the arrival of law enforcement.
Section 2: Sets forth the effective date.
 
DIFFERENCE BETWEEN ORIGINAL AND AMENDED VERSION:
The A-print removes authority beyond the hospital's property that would
have included public streets and sidewalks.
 
JUSTIFICATION:
The ongoing and escalating violence in and around hospitals in the U.S.
is a danger to hospital staff and visitors. Health care workers locally
and across the nation have experienced a sharp increase in incidences of
workplace violence, with no sign that this trend is receding. Health
care workers remain five times more likely than any other type of worker
to be physically attacked on the job, according to the Bureau of Labor
Statistics.
Highland Hospital is facing increasing incidences of violence, drug-re-
lated activities, and presence of weapons which pose significant chal-
lenges to maintaining a secure and safe environment for Highland Hospi-
tal staff, patients, and visitors. Violent Incidents with criminal
intent have increased 100% over the past 2 years at Highland Hospital.
Weapon Confiscation has increased dramatically over the last decade and
in 2024, there were 36 weapons confiscated in total at Highland Hospi-
tal.
Highland Hospital is now the only hospital in the City of Rochester
without peace officer status for its public safety officers. Peace offi-
cer status was granted to Rochester Regional Health in 2024 and to
Strong Memorial Hospital in 2017, Therefore, they are requesting this
legislation to better protect patients and staff amidst an increase in
workplace violence, and the threat of violence towards health care work-
ers.

AN ACT to amend the criminal procedure law, in relation to granting
peace officer status to certain security officers employed by Highland
Hospital
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Section 2.10 of the criminal procedure law is amended by
2 adding a new subdivision 88 to read as follows:
3 88. Officers and members of the security force employed by Highland
4 Hospital, within the grounds or premises owned or under the supervision,
5 administration, or control of Highland Hospital located on the campuses
6 and at the facilities of Highland Hospital, shall have the powers of
7 peace officers, and beyond such geographic area upon the request of the
8 chief law enforcement officer of the local law enforcement jurisdiction
9 or such chief law enforcement officer's designee, for the purpose of
10 transporting an individual who has been arrested in accordance with
11 section 140.27 of this chapter and where no local law enforcement offi-
12 cer is available for transporting such individual in a timely manner.
13 Such peace officers shall only have the powers listed in paragraphs (a),
14 (b), (c), (d), (e), and (h) of subdivision one of section 2.20 of this
15 article, and the power to detain an individual for a reasonable period
16 of time while awaiting the arrival of law enforcement, provided that
17 such peace officer has actual knowledge, or probable cause to believe,
18 that such individual has committed an offense; provided however, that
19 nothing in this subdivision shall be deemed to authorize such officer to
20 carry, possess, repair or dispose of a firearm unless the appropriate
21 license therefor has been issued pursuant to section 400.00 of the penal
22 law.
23 § 2. This act shall take effect immediately.
