  TITLE OF BILL: An act to amend chapter 54 of the laws of 2019, enact- ing the capital projects budget, in relation to including all religious houses of worship in the safety and security projects for at risk facil- ities grant program   PURPOSE OR GENERAL IDEA OF BILL:: This legislation would expand the eligibility requirements for the Securing Communities against Hate Crimes Grant Program to include all houses of worship.   SUMMARY OF PROVISIONS:: Section 1 of Chapter 54 of the Laws of 2019 is amended to add all houses of worship to parties eligible for the grant.   JUSTIFICATION:: The Securing Communities Against Hate Crimes Grant Program provides nonprofit organizations within the State with funding to help mitigate risk associated with the increased number of hate crimes that have occurred in previous years. Unfortunately, the Division of Homeland Security and Emergency Services have adopted strict eligibility require- ments that require nonprofits or religious institutions to also provide educational or daycare services that are registered with the Department of Education. As a result, many religious institutions who do not provide these services, or provide daycare programs not registered with DOE, are not eligible to apply for critical funding that would prevent future acts of hate. This legislation seeks to amend this issue by open- ing up eligibility to all house of worship.   PRIOR LEGISLATIVE HISTORY:: New bill.   FISCAL IMPLICATIONS:: None to the State.   EFFECTIVE DATE:: Immediately.

        AN ACT to amend chapter 54 of the laws of  2019,  enacting  the  capital
          projects  budget,  in  relation  to  including all religious houses of
          worship in the safety and security projects  for  at  risk  facilities
          grant program

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Section 1 of chapter 54 of the laws of 2019,  enacting  the
     2  capital  projects budget, is amended by adding thereto the items herein-
     3  below set forth in italic and is amended by deleting therefrom the items
     4  hereinbelow set forth in brackets as follows:
     5  SAFETY AND SECURITY PROJECTS FOR AT RISK FACILITIES (CCP) ... 25,000,000

     7    Capital Projects Funds - Other
     8    Capital Projects Fund - 30000
     9    Program Improvement/Change Purpose
 
    10  For competitive grants to provide safety and
    11    security projects  at  nonpublic  schools,
    12    community   centers,   residential  camps,
    13    [and] day care facilities  and  all  reli-
    14    gious  houses  of  worship at risk of hate
    15    crimes or attacks because of their  ideol-
    16    ogy, beliefs or mission.  Provided that an
    17    assessment   of  facilities  at  risk  may
    18    include, but not be limited to,  consider-
    19    ations   of  the  vulnerabilities  of  the
    20    organization based  on  its  location  and
    21    membership, and the potential consequences

     1    of a hate crime or attack at the facility.
     2    The  amount  appropriated  herein  may  be
     3    transferred or suballocated to  the  divi-
     4    sion  of  homeland  security and emergency
     5    services to accomplish the intent of  this
     6    appropriation (11HS1908) (55970) ............ 25,000,000
     7    §  2.  This  act  shall take effect immediately and shall be deemed to
     8  have been in full force and effect on the same  date  and  in  the  same
     9  manner as chapter 54 of the laws of 2019 took effect.
