MEMORANDUM IN SUPPORT OF LEGISLATION

  TITLE OF BILL: An act to amend the highway law, in relation to dedicating a portion of the state highway system to Major Andrew D. Byers   PURPOSE OR GENERAL IDEA OF BILL: To dedicate a portion of State Route 324 to Major Andrew D. Byers.   SUMMARY OF SPECIFIC PROVISIONS: Section 1: Designates a portion of State Route 324 in Erie County, New York, as the "Major Andrew D. Byers Memorial Highway." The section of the highway begins at the intersection of State Route 324 and Transit Road and ends at the intersection of State Route 324 and Main Street in the Town of Clarence. Section 2: The Commissioner of Transportation is responsible for installing and maintaining appropriate signage, but the designation will be ceremonial, meaning the highway's official name will not be changed. Section 3: Identifies effective date.   JUSTIFICATION: A native of Clarence, New York, Major Andrew D. Byers was born on September 2, 1986, to David and Rosemarie Byers, brother to Lindsay and Lauren. A 2004 Graduate of Clarence High School, Byers followed his dream to attend the U. S. Military Academy at West Point. Byers graduated from the U.S. Military Academy in 2008 and was commis- sioned in the Infantry. He then commanded a rifle platoon in the 2nd Infantry Division on a tour to Iraq. His first assignment after complet- ing the Special Forces Qualification Course in 2014 was as Executive Officer of Company B, 2nd Battalion, 10th Special Forces Group. He then assumed command of an Operational Detachment - Alpha on a deployment to Chad. Major Byers was killed in action on November 3, 2016, during his third deployment, while his unit was conducting operations with Afghan allies in support of Operation FREEDOM'S SENTINEL.   PRIOR LEGISLATIVE HISTORY: New bill   FISCAL IMPLICATIONS: To be determined.   EFFECTIVE DATE: This act shall take effect immediately.

        Introduced  by M. of A. BOLOGNA -- read once and referred to the Commit-
          tee on Transportation -- committee discharged, bill  amended,  ordered
          reprinted as amended and recommitted to said committee
 
        AN  ACT to amend the highway law, in relation to dedicating a portion of
          the state highway system to Major Andrew D. Byers

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section 1. The highway law is amended by adding a new section 345-d to
     2  read as follows:
     3    §  345-d. Portion of the state highway system to be dedicated to Major
     4  Andrew D. Byers. All that portion of the state highway system constitut-
     5  ing state route three hundred twenty-four beginning at its  intersection
     6  with  Transit  Road,  continuing  in a generally easterly direction, and
     7  terminating at  its  intersection  with  Main  Street  in  the  town  of
     8  Clarence, county of Erie, shall be dedicated to Major Andrew D. Byers.
     9    §  2. The commissioner of transportation shall provide for the instal-
    10  lation and maintenance of adequate signing of the state  highway  system
    11  as  dedicated  pursuant  to  section one of this act, provided that such
    12  signing shall state "Highway Dedicated to Major Andrew D Byers".  Howev-
    13  er, to avoid confusion and to limit any possible disruption of commerce,
    14  the  dedication  called for pursuant to section one of this act shall be
    15  one of ceremonial nature and the official name of such highway shall not
    16  be changed as a result of this act.
    17    § 3. This act shall take effect immediately.
