TITLE OF BILL:
An act to amend the vehicle and traffic law, in relation to removing the
additional service charge for distinctive "Elks Association" license
plates
 
PURPOSE OR GENERAL IDEA OF BILL:
This bill would remove the additional service charge for distinctive
"Elks Association" license plates.
 
SUMMARY OF PROVISIONS:
Section 1: Amends subdivision 3 of section 404-z of the vehicle and
traffic law.
Section 2: Sets the effective date.
 
JUSTIFICATION:
In 2017, the Legislature passed a bill authorizing a specialty license
plate for the Elks Association. However, Elks refused to buy the plates
because the additional monies raised would go to the state's general
fund, not a specialty one. This has been an ongoing issue, as Elks want
to have the distinctive plates they have been waiting on for over six
years. This bill would eliminate the additional fee associated with this
plate, allowing Elks to buy it and finally enjoy a plate of their own.

AN ACT to amend the vehicle and traffic law, in relation to removing the
additional service charge for distinctive "Elks Association" license
plates
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Subdivision 3 of section 404-z of the vehicle and traffic
2 law, as added by chapter 208 of the laws of 2018, is amended to read as
3 follows:
4 3. A distinctive plate issued pursuant to this section shall be issued
5 in the same manner as other number plates upon payment of the regular
6 registration fee prescribed by section four hundred one of this arti-
7 cle[, provided, however, that an additional annual service charge of
8 twenty-five dollars shall be charged for such plate].
9 § 2. This act shall take effect immediately.
