TITLE OF BILL:
An act authorizing the commissioner of general services to transfer and
convey certain unappropriated state land to The Arc Westchester New
York; and providing for the repeal of such provisions upon expiration
thereof
 
PURPOSE OR GENERAL IDEA OF BILL:
To authorize the transfer of a parcel of state-owned, unappropriated
land to The Arc Westchester New York for the continued use and develop-
ment of a group home for adults with developmental disabilities.
 
SUMMARY OF PROVISIONS:
Section 1 authorizes the Commissioner of General Services to transfer
the parcel of state land located at 39 Sullivan Road, in the Town of
North Salem, Westchester County, to The Arc Westchester New York for the
nominal consideration of one dollar and other conditions deemed proper
by the commissioner.
Section 2 provides a legal description of the parcel to be conveyed,
located partially in the Towns of North Salem and Lewisboro, Westchester
County.
Section 3 allows for an accurate survey and legal description to be
submitted by The Arc Westchester and approved by the commissioner.
Section 4 requires The Arc Westchester to apply for the transfer within
one year of the bill's effective date, including a resolution acknowl-
edging and accepting the use restrictions.
Section 5 mandates that the property be used solely for the operation of
a group home for adults with disabilities, and includes a reverter
clause that returns the property to the state should this use cease.
Section 6 sets the effective date and provides that the bill will expire
and be deemed repealed two years after it takes effect.
 
JUSTIFICATION:
This legislation facilitates the transfer of underutilized state proper-
ty to a nonprofit organization providing essential services for adults
with disabilities. The Arc Westchester New York plans to use the site
for a group home, enhancing the availability of supportive residential
services in the region. The bill ensures that the land remains dedicated
to public benefit use by including a reversion clause, safeguarding
state interests if the intended purpose is no longer fulfilled.
Group homes are a critical component of the continuum of care for indi-
viduals with disabilities, offering a stable and inclusive living envi-
ronment. This transfer supports the state's goals of community inte-
gration and accessible care, without requiring substantial fiscal
investment from the state.

AN ACT authorizing the commissioner of general services to transfer and
convey certain unappropriated state land to The Arc Westchester New
York; and providing for the repeal of such provisions upon expiration
thereof
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Subject to the provisions of this act but notwithstanding
2 any other provision of law to the contrary, the commissioner of general
3 services is hereby authorized to transfer and convey The Arc Westchester
4 New York, in consideration of one dollar and upon such other consider-
5 ation as the commissioner may deem proper, the state land located at 39
6 Sullivan Road, in the Town of North Salem and the County of Westchester,
7 declared to be abandoned state land by the office for people with devel-
8 opmental disabilities.
9 § 2. The lands authorized by section one of this act to be transferred
10 and conveyed are as follows:
11 ALL that certain plot, piece or parcel of land with the buildings
12 thereon erected, situate, lying and being partly in the Town of Lewis-
13 boro and partly in the Town of North Salem, shown and designated as Lot
14 No. 2 on a certain map entitled, "Subdivision of Section E Lake Hawt-
15 horne situate in the Town of North Salem and Town of Lewisboro, West-
16 chester County, New York," made by Alexander S. Bunney, dated April 28,
17 1966 and filed in the Office of the County Clerk of Westchester County
18 (Division of Land Records) on May 9, 1967 as Map No. 15408, said lot
19 being bounded and described as follows:
20 BEGINNING at a point on the northwesterly side of Sullivan Road where
21 the same is intersected by the division line between Lots Nos. 1 and 2
22 on said map;
23 Running thence along said last mentioned division line,

1 North 5° 17' 00" West 230 feet and
2 North 54° 05' 25" West 759.01 feet to a point;
3 thence North 63° 12' 55" East 445.27 feet to the division line between
4 Lots Nos. 2 and 3 on said map;
5 thence along the division line between Lots Nos. 2 and 3, South 22°
6 07' 40" East 883.10 feet to the northwesterly side of Sullivan Road;
7 thence along the same,
8 South 58° 55' 00" West 110 feet to the point or place of beginning.
9 The within described premises are known in North Salem as Sheet 45,
10 Block 11361, Lot 22 and in Lewisboro as Sheet 12, Block 11361, Lot 3, on
11 the Tax Assessment Map.
12 § 3. The description in section two of this act of the lands to be
13 conveyed is not intended to be a legal description but is intended to
14 identify the parcel to be conveyed. As a condition of the transfer, The
15 Arc Westchester New York, may submit to the commissioner of general
16 services, for the commissioner's approval, an accurate survey and
17 description of the lands to be conveyed, which may be used in the
18 conveyance thereof.
19 § 4. The office of general services shall not transfer or convey the
20 aforesaid lands unless application is made to the office of general
21 services by The Arc Westchester New York within one year after the
22 effective date of this act. Said application shall be in the form of a
23 resolution setting forth a comprehensive statement approved by its
24 managing board, acknowledging and accepting the use restrictions set
25 forth in section five of this act.
26 § 5. Any lands transferred pursuant to this act shall be used for the
27 purposes of The Arc Westchester New York to utilize the subject property
28 and improve the structures on the subject property to operate a group
29 home for adults with disabilities, and upon termination of such use,
30 title to the lands so transferred shall revert to the state of New York.
31 The reverter interest, specifying that title to the lands so transferred
32 shall revert to the state of New York upon termination of such use,
33 shall be included in any conveyance instrument used to transfer such
34 lands pursuant to this act.
35 § 6. This act shall take effect immediately and shall expire and be
36 deemed repealed 2 years after such effective date.
