NEW YORK STATE ASSEMBLY MEMORANDUM IN SUPPORT OF LEGISLATION submitted in accordance with Assembly Rule III, Sec 1(f)

BILL NUMBER: A8937A
SPONSOR: Rosenthal

TITLE OF BILL:
An act to amend the administrative code of the city of New York, in
relation to requiring certain landlords and property managers to provide
notice to tenants on proper protocols for recycling

PURPOSE OR GENERAL IDEA OF BILL:
This bill will help to promote recycling protocols within multi-family
residential properties.

SUMMARY OF SPECIFIC PROVISIONS:
Section one amends the administrative code of the City of New York by
adding a new section 16-315.1.
Section two establishes the effective date.

DIFFERENCE BETWEEN ORIGINAL AND AMENDED VERSION (IF APPLICABLE):
The A print moves the language to the NYC Administrative Code, removes
references to the Division of Housing and Community Renewal, and
requires the NYC Department of Sanitation to develop the notice. Addi-
tionally, it changes the effective date from 30 days to 180 days.

JUSTIFICATION:
While state and local laws mandate the separation and recycling of vari-
ous materials, compliance remains a significant challenge. Providing
clear and easily accessible information on recycling protocols would
provide clarity for landlords, property managers, and tenants alike.
This legislation addresses this issue by requiring that landlords and
property managers provide tenants with an annual notice detailing the
current recycling requirements, which the sanitation department makes
available to all landlords. Under the legislation, landlords would be
required to distribute this notice annually and upon the signing of a
new lease or renewal lease, ensuring that all residents receive this
information.
Providing such information will have a positive impact on waste manage-
ment and environmental sustainability. Having standardized recycling
notices enhances tenant education and awareness, driving compliance with
existing recycling mandates and creating a cleaner and healthier New
York in return.

PRIOR LEGISLATIVE HISTORY:
New bill.

FISCAL IMPLICATIONS:
Undetermined.

EFFECTIVE DATE:
180 days.
