  TITLE OF BILL: An act to amend the vehicle and traffic law, in relation to requiring motor carriers of passengers to post, for public viewing, certain infor- mation on their websites   PURPOSE OR GENERAL IDEA OF BILL: To require bus carriers to post the safety records of their bus company on the company's website, as listed on the Federal Motor Carrier Safety Administration's website.   SUMMARY OF PROVISIONS: Section 1 of the bill requires motor carriers to post their safety inspection records, as provided on the .website for the federal Motor Carrier Safety Administration, onto the bus carrier's own website for public viewing. This would allow customers to view the company's inspection history, violation summary history, and summary of crashes when the customer goes on the company's website to purchase a bus tick- et. For bus companies that do not have an online website to purchase tickets, the company would be required to post the safety inspection information of the company at the location where the tickets are sold in person to customers. This safety information must be updated at least once every three months. Section 2 states that the act shall take effect 180 days after the bill becomes law.   JUSTIFICATION: On September 18, 2017, bus driver Raymond Mong, employed by charter bus company Dahlia, sped down a street in Flushing, Queens at nearly twice the speed limit, running a red light and crashing into a MTA bus. The crash killed two innocent people, in addition to Mr. Mong. Mr. Mong had previously been convicted of drunk driving in Connecticut while he was driving his car.   PRIOR LEGISLATIVE HISTORY: 2021-22 - A3398/Kim - S3708/Comrie - Referred to Transportation 2021 - New Bill   FISCAL IMPLICATIONS FOR STATE AND LOCAL GOVERNMENTS: None.   EFFECTIVE DATE: This act shall take effect on the 180th day.

        AN  ACT  to  amend the vehicle and traffic law, in relation to requiring
          motor carriers of passengers to  post,  for  public  viewing,  certain
          information on their websites
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. The vehicle and traffic law is  amended  by  adding  a  new
     2  section 509-nn to read as follows:
     3    § 509-nn. Motor carrier information. 1. Each motor carrier shall post,
     4  for  public  viewing,  on  its  website the information relating to such
     5  carrier as posted on the website of the  federal  Motor  Carrier  Safety
     6  Administration including, but not limited to:
     7    (a)  its  United  States  Department  of Transportation identification
     8  number;
     9    (b) its on road performance percentile;
    10    (c) its summary of activities;
    11    (d) its inspection history; and
    12    (e) a summary of its violations.
    13    2. In the event that a motor carrier  does  not  maintain  a  publicly
    14  accessible website, such carrier shall conspicuously post, at each place
    15  where the motor carrier sells tickets for transportation, a notice which
    16  provides the information required by subdivision one of this section.
    17    3.  The  information  required to be provided by this section shall be
    18  updated not less frequently than once every three months.
    19    § 2. This act shall take effect on the one hundred eightieth day after
    20  it shall have become a law. Effective immediately, the addition,  amend-
    21  ment and/or repeal of any rule or regulation necessary for the implemen-
    22  tation  of  the provisions of this act on its effective date are author-
    23  ized to be made and completed on or before such effective date.
