  TITLE OF BILL: An act relating to permitting the Setauket fire district to enter into contracts with the state university of New York at Stony Brook for services and other consideration without public bidding   PURPOSE OR GENERAL IDEA OF BILL: The intent of this legislation is to allow Setauket fire district to store a surplus truck on the campus of Stony Brook University   SUMMARY OF PROVISIONS: Section 1: states that the Setauket fire district may enter into agree- ments and/or contract with SUNY Stony Brook. Further sets out what provision of services these agreements and/or contracts can include but not be limited to. Lastly, states that contracts entered under this section can be facilitated via direct negotiations and shall not be subject to section 103 of the general municipal law or section 176 of the town law. Section 2: this act shall take effect immediately.   JUSTIFICATION: The Setauket Fire District has recently acquired a new fire truck, which has made one of their older fire trucks a surplus to their needs. To mitigate the unnecessary space this surplus truck would take at the department, they entered into a memorandum of understanding with Stony Brook University (located within their fire district). The laws pertain- ing to which municipalities are permitted to contract with the state agencies such as SUNY, does not include fire districts.   PRIOR LEGISLATIVE HISTORY: New Bill   FISCAL IMPLICATIONS FOR STATE AND LOCAL GOVERNMENTS: None   EFFECTIVE DATE: This act shall take effect immediately.

        AN ACT relating to permitting the Setauket fire district to  enter  into
          contracts  with  the  state  university of New York at Stony Brook for
          services and other consideration without public bidding
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1.  Notwithstanding any provision of law to the contrary, the
     2  Setauket fire district may enter into agreements and/or  contracts  with
     3  the  state university of New York at Stony Brook. Such agreements and/or
     4  contracts entered into pursuant to this section may be for the  recipro-
     5  cal provision of services or other consideration of approximately equiv-
     6  alent  value  including,  but  not  limited to, routine and/or emergency
     7  services, moneys, equipment, materials, buildings and facilities;  or  a
     8  commitment  to provide future routine and/or emergency services, moneys,
     9  equipment, materials, buildings or facilities. Any such contract may  be
    10  entered  into  by  direct  negotiations  and shall not be subject to the
    11  provisions of section 103 of the general municipal law or section 176 of
    12  the town law.
